With the rise of incarceration costs at the Suffolk County Correctional
Facility, it is in the best interests of the County of Suffolk to
require certain persons who are incarcerated in the Suffolk County
Correctional Facility and are subsequently convicted of the crime
which led to their incarceration to pay the County of Suffolk for
actual unreimbursed costs of incarceration.
"Incarceration costs" shall mean costs incurred by the Sheriff's
Department in housing a person convicted of a crime, but not limited
to room, board and educational expenses, to be paid as follows:
Any person convicted of a crime which led to his or her incarceration
in the Suffolk County Correctional Facility shall pay the County of
Suffolk for pre-conviction and post-conviction expenses, as set forth
herein, incurred in conjunction with the incarceration of such person.
The Sheriff of the County of Suffolk may waive all or part of
the incarceration costs where, because of the indigence of the person
sentenced, the payment of said costs would work an unreasonable hardship
on the person convicted, his or her immediate family or any other
person who is dependent on such individual for financial support.
In the event of nonpayment of any costs which have not been
waived, the County of Suffolk may seek to enforce payments in any
manner permitted by law for enforcement of a debt.
