An article to establish the residency requirements for the Village Clerk-Treasurer, Deputy Village Clerk-Treasurer, and Code Enforcement Officer for the Village of Oxford.
This article is adopted pursuant to Article 2, § 3, of Public Officers Law and § 3-300, Subdivision 2(a), of Village Law which allows a village by resolution to provide that the office of clerk-treasurer, deputy clerk- treasurer, or code enforcement officer may be held by a person who is not a resident of such village, provided that such person resides in the county or an adjoining county.
The Clerk-Treasurer, Deputy Clerk- Treasurer, or Code Enforcement Officer for the Village of Oxford need not be a resident nor an elector of the Village of Oxford; provided, however, that such person shall reside in the county in which such Village is located (Chenango County).
Any other local laws and ordinances of the Village of Oxford that are inconsistent with the provisions of the article are hereby repealed; provided however, that such repeal shall only be to the extent of such inconsistency and in all other respects this article shall be in addition to such other local laws or ordinances regulating and governing the subject matter covered by the article.
This enactment will allow the Village of Oxford greater flexibility to select the most qualified candidates for the offices of Clerk-Treasurer, Deputy Clerk-Treasurer or Code Enforcement Officer. This will result from the ability to seek a larger pool of candidates from a larger geographical area.
