As used in this article, the following terms shall have the meanings indicated:
MAIN STREET AREA
The area including the following streets: the entire length of Main Street; North Broadway, from Main Street to the high school entrance; South Broadway, from Main Street to 14 South Broadway; the entire length of South Astor Street; and North Astor Street, from Main Street to 22 North Astor Street.
SIDEWALK
Any paved area in the right-of-way between the curb (or edge of the paved road if no curb exists) and the adjacent property line, intended for the use of pedestrians.
A. 
Sidewalks in Main Street area. Every owner of vacant property and every owner, occupant or leaseholder of occupied property in the Main Street area are required to clear all sidewalks in the right-of-way adjacent to their property of snow and ice by 9:00 a.m. and 4:00 p.m. each day, whether or not snow is still falling.

B. 
Other sidewalks. Every owner of vacant property and every owner, occupant or leaseholder of occupied property in the Village other than in the Main Street area are required to clear all sidewalks in the right-of-way adjacent to their property of snow and ice within 12 hours after the snow ceases falling.

C. 
Ice remaining or forming on a sidewalk after the sidewalks have been cleared in compliance with Subsection A or B shall be removed on the same schedule as detailed in Subsections A and B. If the snow and/or ice become so congealed that they cannot be removed, the owner, occupant or leaseholder shall cover the snow and/or ice with clean ashes, sand or other material in such a manner as to enable a person to walk safely on the sidewalk.
D. 
In the event of a snow emergency declared by the Village of Irvington, the provisions of this section shall be suspended until such time as the emergency declaration has expired.

A. 
Any person who violates any provision of this article shall be subject to a penalty of not more than $250 for the first offense, $500 for the second offense within 12 months, and $1,000 for the third and all subsequent offenses within 12 months.
B. 
In addition, and solely at the option of the Village, if snow or ice is not removed in accordance with § 184-36, the Village may clear the snow and ice after notifying the property owner and the occupant or leaseholder if there is one, in writing, that if the sidewalk is not cleared within 24 hours of the time of the notice, the Village will clear the sidewalk and charge the property owner the cost of such snow and/or ice removal.
C. 
If the Village removes the snow and/or ice, it shall charge the property owner the costs thereof, together with a charge of 50% of such costs to cover the cost of supervision and administration. If the property owner does not pay within 30 days of notification of the charges, the charges shall be assessed against the property and become a lien on the property and collected in the same manner as delinquent taxes.
