A.
Establishment of enforcement agency; membership.
(1)
There is hereby established in the Township a State
Uniform Construction Code enforcing agency to be known as the "Division
of Inspections," within the Department of Planning and Development,
consisting of a Construction Official, Building Subcode Official,
Plumbing Subcode Official, Electrical Subcode Official, Fire Protection
Subcode Official and such other subcode officials for such additional
subcodes as the Commissioner of the Department of Community Affairs,
State of New Jersey, shall hereafter adopt as part of the State Uniform
Construction Code.[1] The Construction Official shall be the chief administrator
of the enforcing agency.

There are hereby established the positions of Acting
Construction, Building, Fire Protection, Elevator and Electrical Code
Officials to act in the capacity of those duly appointed officials
who are absent from their offices, or when there is a conflict or
the appearance of impropriety. The appointed acting officials will
only act when authorized by the Construction Official. All appointed
acting officials shall be licensed in accordance with N.J.A.C. 5:23-5.4
and perform their respective duties in accordance with N.J.A.C. 4:23-4.5(f)
and (g).

B.
Qualifications. Each official position created in Subsection A shall be filled by a person qualified for such position pursuant to N.J.S.A. 52:27D-119 et seq., as amended, and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to N.J.S.A. 52:27D-119 et seq., and N.J.A.C. 5:23 to hold each position.
The public shall have the right to do business
with the enforcing agency at one office location except for emergencies
and unforeseen or unavoidable circumstances. The location of the office
shall be in the Municipal Buildings, Bargaintown Road and Central
Avenue, Egg Harbor Township.
Appeals from decisions of the enforcing agency
shall be heard under the rules and regulations established by the
Atlantic County Construction Board of Appeals.

Township construction permit fees shall be computed
in accordance with the Uniform Construction Code provisions at N.J.A.C.
5:23-4.20. The fee for a construction permit shall be the sum of the
subcode fees listed and shall be paid before the permit is issued.

Continued certificate of occupancy: $200.

B.
Reinstatement of unexpired lapsed and/or suspended
permit.
(1)
Reinstatement of unexpired lapsed and or suspended
permit fee shall be 50% of original computed permit cost.
(2)
Permits will not be reinstated if:
(a)
A construction permit is issued in accordance with
the Uniform Construction Code provisions, pursuant to which no construction
has been undertaken above the foundation wall within one year from
the time of issuance.
(b)
A new code is adopted during the period that work
is suspended or abandoned for a period of one year after the time
of the last inspection.
C.
Fees for electric and plumbing permits shall be as stated in N.J.A.C. 5:23-4.20, along with § 89-6B below.

D.
The minimum fee to be charged for permits is $60. Fees for building
and fire permits shall be as follows:

(1)
Fees for new construction shall be based upon volume of the structure.
Volume shall be computed in accordance with N.J.A.C. 5:23-2.28. Use
groups B, H, I-1 to I-3, M, E, R-1 to R-5 and U shall be .036 per
cubic foot of volume. Use groups A-1 to A-5, F-1 and F-2, and S-1
and S-2 shall be .021 per cubic foot of volume. Commercial farm buildings
under N.J.A.C. 5:23-3.2(d) shall be 15 per cubic foot of volume.
(2)
Fees for renovations, alterations and repairs of site construction
associated with pre-engineered systems of commercial farm buildings
and retaining walls shall be based upon the estimated cost of work,
all use groups, as follows:
(a)
Estimated cost of construction up to $50,001 shall be $40 per
$1,000; $50,001 to $100,001 shall be $30 per $1,000; over $100,001
shall be $25 per $1,000, prorated. For the purpose of determining
estimated cost, the applicant shall submit to the Building Department
such cost data as may be available by the architect or engineer of
record, by a recognized estimated form or by the contractor. A bona
fide contractor's bid, if available, shall be submitted. The Building
Department shall make the final decision regarding the estimated cost.
(b)
The fee for remanufactured construction and the external utility
connection for premanufactured construction shall be at $100 per $1,000
of estimated cost of construction.
(c)
Tents in excess of 900 square feet or more than 30 feet in any
dimension shall be $250.
(d)
The fees for pools shall be as follows: R-3 and R-5 shall be
$150 for aboveground pools and $250 for in-ground pools. All other
groups shall be $300 for aboveground pools and $400 for in-ground
pools.
(4)
Demolition or removal.
(a)
Residential and utility use group, less than 5,000 square feet
and 30 feet in height: $200. All other use groups shall be $350. Tanks
shall be $150.
(5)
Certificate fees.
(a)
The fee for a residential certificate of occupancy shall be
$50. All others shall be $75.
(b)
The fee for a certificate of occupancy granted pursuant to a
change of use group shall be $200.
(c)
The fee for a certificate of continued occupancy issued under
N.J.A.C. 5:23-2.23(e) or the request of an owner shall be $200.
(d)
The fee to renew any temporary certificate of occupancy shall
be $50.
(6)
Plan review fee for compliance under the alternate systems and nondepletable
energy source provisions of the energy subcode shall be as follows:
(a)
R-3 and R-5 use group $400. All others are $2,000.
E.
The minimum fee to be charged for fire permits is $60. Fees for fire
permits shall be as follows:

(1)
Sprinkler heads (wet or dry).
(a)
The fee for one to 20 heads shall be $100; 21 to 100 heads shall
be $200; 101 to 200 shall be $300; 201 to 400 shall be $800; 401 to
1,000 shall be $1,100, and 1,001 and above shall be $1,500.
(2)
Detectors and alarm devices.
(a)
The fee for one to 12 devices shall be $60; each additional
20 shall be $25.
(3)
Sandpipes shall be $350 each.
(4)
Independent pre-engineered systems shall be $150 each.
(5)
Gas- or oil-fired appliances shall be $75 each.
(6)
Residential kitchen exhaust system shall be $60 each. All others
shall be $150 each.
(7)
Incinerator/crematorium shall be $600 each.
(8)
Residential tanks shall be $100 each. All other shall be $250 each.
The Construction Official shall, with the advice
of the Subcode Officials, prepare and submit to the Township Committee
biannually a report recommending a fee schedule based on the operating
expenses of the agency and any other expenses of the Township fairly
attributable to the enforcement of the State Uniform Construction
Code Act.[1]

A.
In order to provide for training, certification and
technical support programs required by the Uniform Construction Code
Act, the enforcing agency shall collect a surcharge fee based upon
the volume of new construction within the Township. Said fee shall
be accounted for and forwarded to the Department of Community Affairs,
Division of Codes and Standards in the manner as set forth in N.J.A.C.
5:23-4.19(b) and (c).
B.
An administrative fee shall be charged by the Township
in accordance with N.J.A.C. 5:23-4.18(j); the fee is 50% of the permit
cost.

C.
An administrative surcharge fee equaling 10% of the permit cost shall
be imposed by the Township on all permit applications in accordance
with N.J.S.A. 52:27D-124.4.

The implementation of the provision of establishing
fire limits within the jurisdiction is being delayed until July 1,
1977, as provided in the regulations. The Construction Official shall
prepare and submit to the Township Committee by May 1, 1977, a report
delineating the fire limits. This report shall indicate the recommendations
of the Construction Official, the Building Subcode Official and Fire
Subcode Official regarding those areas which should be designated
as within fire limits, with the reasons therefor.
The provisions of this chapter shall take effect
on January 1, 1977.
