For the purposes of this chapter, "fishing" and "crabbing" shall
be defined as all activities designed or engaged in for which the
purpose is to capture wild vertebrates, invertebrates and plants,
including but not limited to fish, crabs or any other crustaceans,
and regardless of the method employed, including but not limited to
the use of bait, tackle, strings, traps or nets. The failure of such
activities to capture the creatures described above is not determinative
of whether the activity constitutes fishing and crabbing.
The Mayor is authorized to establish areas within Chesapeake
Beach in which fishing or crabbing shall be prohibited to protect
either the property involved or to serve the public interest. To establish
such areas, the Mayor shall post on the property a sign which shall,
at a minimum, state: "Fishing and Crabbing Prohibited. Violators subject
to a fine of $300." The Mayor is authorized to establish such "no
fishing or crabbing" areas on any public property, even if that property
is otherwise open and available to the public for the public's
use and enjoyment.
It shall be unlawful for a person to engage in the activity
of fishing or crabbing within 100 feet of a "no fishing or crabbing"
sign established by the Mayor pursuant to this chapter.
Any person or entity violating the provisions of this chapter
shall be guilty of a municipal infraction and, upon conviction thereof,
is subject to a fine of $300.
