A. 
The Mayor is authorized to acquire interests in real property, including but not limited to fee-simple ownership, defeasible ownership, easements, license agreements and equitable interests, for the purpose of constructing, repairing and maintaining water and sewer utilities, upon all of the following conditions being met:
(1) 
The Mayor determines that it is in the public interest to acquire the real property interest to allow improvements to the water and sewer utility system.
(2) 
All agreements for the acquisition of a real property interest shall be evidenced in writing and signed by the grantor and the Mayor.
(3) 
The agreement shall not require the payment of funds in excess of the Mayor's authority to expend funds as set forth in the Charter.
B. 
The Mayor is authorized to execute agreements to acquire real property interests in accordance with this article, without further ratification of such authority or of the agreement by the Town Council.
