Except for Section 123.10.0, Appeals, the Calvert County Stormwater Management Ordinance, including any future amendments thereto, is adopted by the Town of Chesapeake Beach and shall be applicable to all development within the corporate limits of Chesapeake Beach, Maryland. Calvert County is authorized to administer and enforce the provisions of said Stormwater Management Ordinance, and all additional provisions of this chapter, within the corporate limits of the Town.
A. 
This section shall govern all appeals from any action of an official charged with enforcement of the Calvert County Stormwater Management Ordinance relating to development within the corporate limits of Chesapeake Beach, Maryland and shall supersede Section 123.10.0, Appeals, of the Calvert County Stormwater Management Ordinance.
B. 
Any person aggrieved by the action of any official charged with the enforcement of the Calvert County Stormwater Management Ordinance adopted by § 236-1, as a result of the disapproval of a properly filed application for a permit, issuance of a written notice of violation, or an alleged failure to properly enforce said ordinance in regard to a specific application, shall have the right to appeal the action to the Town Council of Chesapeake Beach. The appeal shall be filed in writing within 30 days of the date of official transmittal of the final decision or determination to the applicant and shall state clearly the grounds on which the appeal is based. The appeal shall be heard on a de novo basis.
A. 
This section shall govern the notice requirements for a waiver or variance from the Calvert County Stormwater Management Ordinance provided by § 236-1 applicable to development within the corporate limits of Chesapeake Beach, Maryland, and said requirements shall be considered as additional requirements to those set forth in § 123.3.3, Waivers/Watershed Management Plans, and § 123.3.5, Variance.
B. 
Any person who submits a written request to the Department of Public Works for Calvert County for a waiver pursuant to § 123.3.3, Waivers/Watershed Management Plans, or a variance pursuant to § 123.3.5 of the Calvert County Stormwater Management Ordinance shall provide written notice to the Town Clerk of Chesapeake Beach within three days of the request. The written notice shall include the name of the applicant and a brief statement of the nature of waiver or variance requested. Any person who submits a request for a waiver or variance pursuant to § 123.3.3 or § 123.3.5 consents to the posting of said property as provided in Subsection C of this section.
C. 
Upon receipt of written notice for a variance from the Calvert County Stormwater Management Ordinance, the Town Clerk shall give notice by posting, in a conspicuous place on the property involved, a notice of the pending action containing a brief statement of the nature of waiver or variance requested and a statement that any appeal of the decision must be filed with the Town Council of Chesapeake Beach, with a copy to the Department of Public Works of Calvert County, Maryland.
