The East Brandywine Fire Company, Minquas Ambulance and Washington Hose Ambulance, hereinafter "emergency service providers," are providers of emergency services for the Township of East Brandywine.
The emergency services providers respond to fire, rescue and emergency medical incidents, hazardous material incidents, environmental incidents, and other emergencies.
Said responses may involve the use of emergency equipment and materials, and hazardous abatement equipment and materials.
It is appropriate for East Brandywine Township to recognize the authority of the said emergency services providers to recover their costs and expenses related thereto from those who have benefited thereby.
The Board of Supervisors of East Brandywine Township hereby authorize the emergency services providers to recover from those who have benefited thereby the reasonable costs of fire-fighting materials and hazardous abatement equipment and materials involved in any hazardous material incident, environmental incident, or fire, rescue or emergency medical incident or operation, including vehicular accidents. Furthermore, in addition to the aforementioned reasonable costs, the emergency services providers are hereby authorized to collect reasonable interest as well as reasonable administrative fees for collecting said costs and any and all additional fees as authorized by any statute, case law, or common law. Such costs and fees shall be no higher than the maximum available from applicable homeowners' insurance policies, automobile policies, or medical insurance policies.
