This chapter shall be known and may be cited as the "City Administrative
Code of the City of Atlantic City."
The purpose of this chapter shall be to establish departments;
allocate the City's functions, powers and duties among and within
the departments; establish official relationships and prescribe standards
and procedures for the conduct of the public business; pursuant to
N.J.S.A. 40:69A-1 et seq.

Terms
defined. For the purposes of this chapter, the following terms shall
have the meanings indicated:
The Business Administrator appointed pursuant to the Charter
and this chapter, or Acting Administrator temporarily serving in place
of the Business Administrator.
Mayor-Council plan of the Optional Municipal Charters Law
(OMCL) of N.J.S.A. 40:69A-1 et seq., and all applicable provisions
of general law as provided therein.
The City of Atlantic City in the County of Atlantic, State
of New Jersey.
The Municipal Clerk appointed pursuant to the Charter or
ordinance.
The Administrative Code of the City of Atlantic City as adopted.
The governing body of the City, constituted and elected pursuant
to the Charter.
A major organization unit of the City government established
as such pursuant to this chapter.
The administrative head of a department.
The City Council.
The chief executive officer of the City.
A calendar month, unless otherwise specifically provided.
An act in permanent, uniform regulation of public or governmental
conduct, required by law to be written, published and adopted after
public hearing at a meeting following the one at which it is introduced.
An action expressing the sense or will of the Council on
a matter of special or temporary interest, which shall be written
and may be adopted at the meeting at which it is introduced, without
publication or public hearing.
A calendar year, unless otherwise specifically provided.

Word
usage and construction. For the purpose of this chapter and any other
ordinances or resolutions heretofore or hereafter adopted, except
as the context may otherwise require:
(1)Â
The present tense includes the past and future tenses; and the future,
the present.
(2)Â
The masculine gender includes the feminine and neuter.
(3)Â
The singular number includes the plural; and the plural, the singular.
(4)Â
"Shall" is mandatory, and "may" is permissive.
(5)Â
The time within which an act is to be done shall be computed by excluding
the first day and including the last day; and, if the last day is
a Saturday, Sunday or a legal holiday, that day shall be excluded.
(6)Â
"Writing" and "written" mean any visual mode of reproducing words
or numbers on paper or similar material that is in general use.

It
is the intent of the Council in enacting this chapter to exercise
fully the powers delegated by this chapter to organize and regulate
its internal affairs fully, and the provisions of this chapter should
be construed liberally to that end.

This
chapter shall be interpreted and administered so as to maintain the
separation of legislative and administrative powers as provided in
this chapter.
