Housing Authority — See Ch. 32.
A. 
There is hereby created the Atlantic City Housing Advisory Commission.
B. 
The Commission shall be comprised of 12 residents of Atlantic City to be appointed by City Council for terms of three years, beginning on February 1, 2004, and until their successors are appointed and qualified. The terms of the members first appointed shall be as follows:
(1) 
Four members for terms of three years.
(2) 
Four members for terms of two years.
(3) 
Four members for terms of one year.
C. 
Thereafter, the term of each member shall be three years. A member may be removed from service on the Commission by a two-thirds vote of the full membership of the Commission for failure to attend three or more consecutive meetings for the Commission. Upon the removal of a member, the Chairperson of the Commission shall notify the President of City Council and a request for the appointment of a new person to fill the vacancy created. A vacancy occurring other than by expiration of a ten shall be filled for the unexpired ten only, by appointment of City Council.
D. 
City Council may, by a two-thirds vote of its full membership, appoint a nonresident to fill a position on the Commission if no resident qualified pursuant to § 31-2A below can be found.
E. 
Upon the occurrence of any vacancy on the Commission, the Chairperson or his or her designee shall immediately give simultaneous written notice of such vacancy to all members of City Council, which notice shall also state the category and ward representation, if any, of the vacating member.
A. 
The appointment of members of the Commission shall be representative of all wards of the city, as required by Chapter 4 of the Code of Atlantic City, except that when a vacancy occurs on the Commission and said vacancy creates a need for an appointee who qualifies pursuant to one of the categories set forth in § 31-2A below, and after the passage of 45 days from the date of notice to City Council regarding such vacancy no replacement having such qualification can be found within the appropriate ward, City Council may, by a two-thirds vote of its full membership, waive the requirement for ward representation and appoint someone from outside the appropriate ward.
B. 
The membership of the Commission shall include at least one of the following:
(1) 
A housing developer;
(2) 
A representative from a commercial real estate lending institution;
(3) 
A land use or housing planner; and
(4) 
A member of the Greater Atlantic City HUD Tenant Coalition.
C. 
The members of the Commission shall elect a Chairman and a Vice Chairman and other officers which they deem appropriate. An officer shall be permitted to serve more than one term, if so elected, but no more than two terms consecutively.
A. 
The Commission shall utilize parliamentary procedures and establish bylaws for the orderly conduct of its meetings.
B. 
The meetings of the Commission shall be open to the public and all meetings of the Commission shall be held in compliance with the New Jersey Open Public Meetings Act (N.J.S.A. 10:4-6 et seq.).
A. 
The members of the Commission shall serve without compensation for the faithful performance of their duties. No one shall, by virtue of his or her service on the Housing Advisory Commission, be precluded from earning professional fees in the practice of his profession in Atlantic City.
B. 
A member shall abstain from voting on matters which hold the potential of a conflict of interest for such member. Each member shall disclose any pecuniary interest the member or any of his family members may have in any housing program or project in the City of Atlantic City.
A. 
The city shall appropriate such funds as it deems necessary for the proper administration and functioning of the Commission.
B. 
The Commission shall meet at a location provided by the City of Atlantic City at such times as may be determined by the Commission.
The Commission shall have the following duties:
A. 
To make recommendations on private or public housing projects requiring city, governmental or administration approval, as provided in this chapter, regarding the number of low- or moderate-income housing units to be provided by any proposed, new or renovation to existing housing development within the city.
B. 
To make recommendations regarding quality and code enforcement of existing low- and moderate-income housing in the city.
C. 
To serve as an advisory board to the Planning and Zoning Boards for the purpose of making recommendations regarding proposed housing projects.
D. 
To file an annual report on or before March 15 of each year (excepting the first year of the Commission's creation) to the City Council, Planning Board and Zoning Board regarding the projects reviewed and other activities of the Commission during the year setting forth any findings and recommendations it may have to improve the number and quality of the City's low- and moderate-income housing stock.
