A. 
Schedule A (alphabetically listed) and Schedule B (listed by department and division), attached hereto and made a part hereof, shall constitute the titles and salary levels of the positions of the officers and employees of the City of Atlantic City.
B. 
Schedule C, which is attached hereto and made a part hereof, shall constitute the salary ranges, minimum and maximum, for each salary level, as indicated in Subsection A above. In the event that a position has two salary ranges, the applicable range for an officer or employee shall be the range wherein his or her present salary is located. The officer or employee's salary shall be governed by his or her present range, and he or she shall not be paid lower than the minimum or higher than the maximum of said range.
C. 
In addition to the positions listed on Schedule B, attached hereto, further positions are authorized to those departments/divisions which are listed on Schedule D, which is attached hereto and made a part hereof. However, said positions listed on Schedule D shall not be filled by the appointing authority without prior approval by resolution of City Council. Such resolution shall need five affirmative votes.
No position or salary shall be created, continued or changed except as provided for in this Part 1. Any position not provided for in this Part 1 or by law shall terminate immediately upon adoption of this Part 1.
Merit raises may be granted by the appointing authority only once per person in a twelve-month period and may not exceed $1,000, subject to budgetary sufficiency; provided, however, that a merit raise cannot increase a salary beyond the maximum range for the position held by said person. The City Council shall be notified immediately by the Comptroller of any such merit raises.
A. 
Sick time, vacation time, longevity and other fringe benefits shall be as provided by ordinance.
B. 
Any ordinance adopted pursuant to this section shall include a provision that upon separation, to the extent that the separating employee may otherwise be eligible to receive payment for such authorized and approved accumulated vacation, sick time, overtime and compensatory time, any payment for same shall be calculated at, and shall not exceed, the employee's base rate of pay as of their last pay date, or December 31, whichever is the earlier, accumulated during the year in which the vacation, sick time, overtime and/or compensatory time was earned.

Editor's Note: This ordinance also provided the following: "The provisions of this ordinance shall not be deemed to abolish or abrogate rights or benefits enured to the benefit of existing employees pursuant to the provisions of any preexisting collective bargaining agreement(s), but shall be applicable to all hires after the effective date of this ordinance and to any future collective bargaining negotiations."
The salary ranges listed above are on a per annum basis, payable in biweekly installments.
