A. 
Writing, printing or placing of graffiti unlawful. No person shall write, print or place graffiti on the real or personal property of another, whether said personal property or real property is publicly or privately owned, unless the owner of said property shall have specifically consented to the same.
B. 
Sale of indelible makers and spray paint containers to minors prohibited. No person, partnership, firm or corporation shall sell or otherwise transfer any spray paint container or indelible markers to a person under the age of 18 years of age, unless said underage person is accompanied by a parent or legal guardian at the time of the purchase or transfer. For purposes of this section "indelible markers" shall be defined as any felt tip marker, china marker or similar device that is not water-soluble and which has a flat or angled writing surface one-half-inch or greater.

Any person in violation of any of the provisions of this article shall, upon conviction thereof before the Municipal Court Judge of the City of Atlantic City, be sentenced to pay a fine not exceeding $2,000 and/or be imprisoned for not more than 90 days and/or be sentenced to a period of not more than 90 days' community service, including not less than 100 hours of graffiti removal, in the discretion of the Municipal Court Judge.
