The Planning Board shall prepare and the City Council may, by ordinance, adopt or amend a capital improvements program for the City of Atlantic City pursuant to the standards and procedures set forth in this article in conjunction with the development and adoption of a Master Plan as provided in Article VIII of this chapter.
A. 
General definition.
(1) 
The capital improvements program shall implement and shall be consistent with the Master Plan except to the extent that deviations from the Master Plan are authorized pursuant to § 163-51C of this chapter.
(2) 
The capital improvements program shall be a program of municipal capital improvement projects, with their estimated costs, projected over a period of at least six years. The program shall include major projects currently being undertaken or to be undertaken with federal, state, county and other public funds or under federal, state or county supervision. Such projects may include any major nonrecurring expenditure or any expenditure for physical facilities of government, such as costs for acquisition of land or interests in land; construction of buildings or other structures, including additions or major alterations; construction of streets and utility lines; construction or installation of public improvements; acquisition of fixed equipment; installation of landscaping; and similar expenditures.
B. 
Specific contents. The capital improvements program shall include the following:
(1) 
A classification of the recommended projects based on their urgency and need for realization.
(2) 
A recommendation of a time sequence to be followed in implementing the recommended projects.
(3) 
The estimated cost and revenues, if any, of each project, including estimates of the probable operating and maintenance costs.
(4) 
A tabulation of existing sources of funds, listing source and amount for each project, and, where such sources are insufficient, the need for additional sources of funds for the implementation and operation of each project.
(5) 
An estimate of the number of persons and establishments which will be displaced by each recommended project.
(6) 
Such other elements as the Planning Board or City Council may find useful or appropriate.
A. 
General purpose. The capital improvements program shall serve as a systematic review of proposed projects to ensure coordination of expenditures and development. The program shall tie together the timing, location and financing of proposed projects, shall encourage the development of projects in scheduled stages and shall provide developers with an advance picture of future needs and development activities to be undertaken by the City of Atlantic City.
B. 
Capital budget. The first year of the capital improvements program shall, upon adoption by the City Council, constitute the capital budget of the City of Atlantic City as required by N.J.S.A. 40A:4-43 et seq.
C. 
Binding effect. The capital improvements program shall, upon being proposed by the Planning Board as part of the Master Plan, have the same binding effect as provided for the Master Plan in § 163-42 of this chapter.
A. 
Program development.
(1) 
The Planning Board, with the assistance of the Land Use Administrator, shall exercise the powers and duties delegated to it by Article V of this chapter in the preparation, adoption and amendment of a proposed capital improvements program and amendments thereto in conjunction with the adoption of a Master Plan pursuant to Article VIII of this chapter.
(2) 
In addition to the procedures specified in Article VIII of this chapter with respect to the development of the Master Plan, the Planning Board shall, in developing the capital improvements program element of the Master Plan, request from every City department, authority and agency a statement of all capital projects proposed to be undertaken by such department, authority or agency within the proposed term of the capital improvements program. The Planning Board shall inventory and study the potential projects identified in such statements, including the cost estimates therefor, and shall include in the capital improvements program a discussion of the merits of each such project; recommendations for implementing, modifying or abandoning each such project; and an evaluation of the relative priorities of the various projects.
(3) 
In preparing the program, the Planning Board shall confer with and make all reasonable efforts to obtain the views, comments and criticisms of the Mayor, the City Council, the chief fiscal officer, the school boards and other interested departments, bureaus, agencies, organizations, groups, firms and residents of the City. To the extent possible, the capital improvements program shall be based on existing information in the possession of the various departments and agencies of the City of Atlantic City. The program shall, as far as possible, take into account public facility needs indicated by prospective development as shown in the Master Plan.
B. 
Hearings on the proposed capital improvements program. The Planning Board shall, prior to making its recommendations on a proposed capital improvements program to the City Council, set, advertise and conduct at least one public hearing on the proposed program in accordance with Part 5, Article XXXIII, of this chapter. Such hearing may be conducted simultaneously with the hearing required on the Master Plan pursuant to § 163-43B of this chapter, but separate notices of such hearings shall be given in accordance with the requirements of Part 5, Article XXXIII, of this chapter.
C. 
Adoption of the capital improvements program by the City Council. Following the development of the capital improvements program pursuant to Subsection A above and after holding a public hearing on the proposed capital improvements program pursuant to Subsection B above, the Planning Board shall recommend such program to the City Council for adoption as the capital improvements program and budget of the City. The City Council may adopt such program, with or without modifications, by the adoption of any ordinance so providing; provided, however, that no modification of the program as recommended by the Planning Board shall be adopted except by the affirmative vote of a majority of the full authorized membership of the City Council, with the reasons for said modifications recorded in the minutes of the Council. The Land Use Administrator shall give notice of such adoption pursuant to Part 5, Article XXXIII, of this chapter.
D. 
Program amendment.
(1) 
The capital improvements program or any part thereof may be amended at any time in the same manner as herein provided for its original development and adoption.
(2) 
The Planning Board shall, within one year following the adoption of the City's first capital improvements program and at annual intervals thereafter, develop and propose, pursuant to Subsections A, B and C above, a proposed amendment to the capital improvements program extending said program for an additional year and making such revisions as are necessary or appropriate in light of actual experience during the preceding year.
E. 
Program filing. The ordinance by which the City Council adopts the capital improvements program or any amendment thereto shall provide that the Land Use Administrator shall cause certified copies thereof to be placed on file in the offices of the Planning Board, the Board of Adjustment, Land Use Administration, the City Clerk and the City Engineer and shall cause a certificate evidencing the adoption of such program to be filed with the County Clerk of Atlantic County.
