Town of Amherst, NY PART VIII PARKING LOTS

§ 83-8-1 Applications and plans.

1-1. All applications for a building permit shall show the required off-street parking, pursuant to the area requirements of Chapter 203, Zoning, of the Code of the Town of Amherst. If off-street parking is not required, a statement to that effect shall be endorsed on said application by the Commissioner of Building.

1-2. Parking areas and parking lots not included in an application for a building permit require an application to be filed accompanied by plans for a permit to construct same and shall show the layout and location of off-street parking and loading areas, layout of the individual parking spaces, type and thickness of pavement, landscaping, drainage details, fences, barricades, drives, aprons, sidewalks, signs and public lighting. No part of any highway right-of-way shall be included in a parking lot.

1-3. Individual parking spaces shall be marked on the pavement when the lot is complete.

1-4. At all times parking lots shall be clean and orderly and free of rubbish and weeds.

1-5. The provisions of this part will not apply to single-family dwellings in the S-A zoned district, unless there exists an accessory use which requires more than a normal residential parking area.

§ 83-8-2 Paving.

2-1. Every parking lot shall be paved with the type of material and thickness sufficient to support the loads to be imposed and with a surface not subject to excessive dusting.

2-2. Paving may be of concrete of a minimum thickness of five inches, three courses of asphaltic concrete of a minimum total thickness of nine inches or other materials complying with the above subsection and approved by the Commissioner of Building.

2-3. Concrete pavement shall comply with the requirements of Article IX governing the construction of sidewalks.

2-4. Asphaltic concrete pavement shall be in three courses. The base course shall consist of good quality crush stone, gravel or other acceptable local material, uniformly spread and compacted with a power roller weighing not less than 10 tons. The coarse aggregate shall range in size from 2 1/2 inches to one inch and shall be filled with a fine aggregate ranging in size from 1/2 inch down. As rolling proceeds, additional fine aggregate shall be added until the voids are filled. The minimum finished thickness shall be at least six inches. The surface courses shall consist of a mixture of coarse and finer mineral aggregate and asphalt cement incorporated together in accordance with New York State Department of Transportation (NYSDOT) standards and specifications. If one or more NYSDOT material specifications contained in this chapter become obsolete, renumbered or are found to be unacceptable by the Commissioner of Building, the Commissioner of Building shall designate one or more acceptable replacements for the material specifications. The asphaltic concrete shall be spread and finished with mechanical self-powered pavers or by acceptable hand methods. All joints such as occur between working days shall be set up so that when rolled they shall be thoroughly filled and level with adjacent areas. It shall be rolled at the proper temperature to prevent undue shoving with tandem rollers weighing five tons to 10 tons. The minimum thickness shall be at least three inches (two inches of binder and one inch of top). After completion of the surface course, no vehicle shall be permitted on the pavement until it has cooled to a surface temperature of 75° F. or at least four hours, whichever is greater.

§ 83-8-3 Drainage.

3-1. All parking lots shall be so graded that stormwater will flow away from any building and will not drain upon abutting properties, sidewalks and pavements.

3-2. Drainage for all parking lots shall be designed in accord with standards and recommendations in the Storm Drainage Design Manual, published by the Erie and Niagara Counties Regional Planning Board, using the rational method and a minimum recurrent storm of 10 years, and shall lead to an approved public outfall.

3-3. All drainage pipes and appurtenances shall be installed by a licensed master plumber or licensed sewer contractor and shall be done only after receiving a permit from the Commissioner of Building and paying the prescribed fee.

§ 83-8-4 Barricades.

4-1. Every parking space that abuts a property line shall be provided with a barricade to prevent the encroachment of vehicles over the property line.

4-2. The following barricades are approved for use in parking lots in the Town of Amherst:

A. The following, provided that they are located four feet from any property line and installed in accord with Drawing No. 1:

(1) Town of Amherst standard concrete curb.

(2) Reinforced concrete bumper.

(3) Reinforced timber bumper.

B. The following, provided that they are located two feet from any property line and installed in accord with Drawing No. 1:

(1) Guardrail bumper.

(2) Welded four-inch pipe bumper.

(3) Pole and timber bumper.

4-3. The color of all barricades shall be such that they contrast with the pavement and are readily discernible at all times of the day or night.

4-4. Barricades other than the typical barricades listed above may be installed upon the approval of the Commissioner of Building.

§ 83-8-5 Aprons.

5-1. All aprons installed on driveways connecting to a Town highway shall conform to Town of Amherst Curb Cut Specifications, published by the Town of Amherst Highway Department.[1]

5-2. All apron widths and ditch culverts connecting to state and county highways shall be installed in accordance with the highway work permit issued and with all state and county laws, rules and regulations.
