This chapter shall be entitled "Local Law No. of 2003 of the Incorporated Village of West Hampton Dunes, a Local Law Regulating the Use of Exterior Generators in the Village of West Hampton Dunes."
Pursuant to § 10 of the Municipal Home Rule Law and the Village Law of the State of New York, the Incorporated Village of West Hampton Dunes, County of Suffolk, and State of New York, hereby enacts by this chapter a local law of the Village of West Hampton Dunes.
The Board of Trustees of the Village of West Hampton Dunes determines and finds that it is in the best interests of the Village, its residents, property owners and guests, and of the preservation of good order and public safety in the Village of West Hampton Dunes to prohibit the use of generators outside of or on the exterior of homes and buildings between the hours of 5:00 p.m. and 10:00 a.m. on weekdays and from 5:00 p.m. on Friday until 10:00 a.m. on Monday of each week.
The purpose and intent of this chapter is to protect the safety and well-being of the residents of the Village and their guests and families as well as the atmosphere and peace and tranquility of the Village by prohibiting the use of generators outside of or on the exterior of buildings during designated times.
It shall and hereby is prohibited for any person or party to use a generator or similar engine or machine outside of or on the exterior of any building or structure in the Village of West Hampton Dunes during the hours of 5:00 p.m. until 10:00 a.m. on weekdays, from 5:00 p.m. on Fridays until 10:00 a.m. the following Monday, and at all times on weekends and holidays.

Each violation of this chapter shall be subject to a fine of not more than $250, and each day that a violation shall exist shall be a separate violation of this chapter. The owner of the property on which the violation occurs and the contractor or other party that was operating the generator shall both have committed an act in violation of this chapter.
