As used in this article, the following terms shall have the
meanings indicated:
The Director of Public Safety or members of the Department
of Public Safety designated by the Director of Public Safety shall
be the "authority" having the jurisdiction of the administration and
enforcement of this article.
A single unit providing complete, independent living facilities
for one or more persons, including permanent provisions for living,
sleeping, eating, cooking and sanitation.
The time in minutes or hours, that materials or assemblies
have withstood a fire exposure as established in accordance with the
test procedures of the National Fire Protection Association's
Standard Methods of Fire Tests of Building Construction and Materials
(NFPA 251-1972).
The owner or owners in fee of the property or a lesser estate
therein, a mortgagee or vendee in possession, an assignee of rents,
receiver, executor, trustee, lessee or any other person, firm or corporation,
directly or indirectly in control of a building.
A system of interconnected smoke detectors powered from a
one-hundred-twenty-volt AC electrical power source, which may be reduced
to low voltage, and arranged so that the actuation of any of the interconnected
smoke detectors shall result in the alarm sounding in each of the
detectors.
An Underwriters' Laboratories, Inc. (UL) label, approved
smoke-detecting device, sensing visible or invisible particles of
combustion and providing an automatic alarm and listed in accordance
with UL No. 217, Standard for Safety, Single and Multiple Station
Smoke Detectors, Second Edition, 1978.
On or before April 1, 1981, all existing multiple dwelling buildings
consisting of four or more dwelling units shall be equipped with an
approved smoke detection system.
It shall be the responsibility of the owner of each building
to have an approved fire detection system installed and to maintain
the system in proper working order.
In all multiple dwelling buildings consisting of four or more
dwelling units, there shall be installed a smoke detection system
providing a minimum of one smoke detector located in the basement
and/or cellar and a minimum of one smoke detector located on each
hallway level.
A.
A permit for the installation of the smoke detection system shall
be obtained from the Electrical Bureau, City of Hoboken, New Jersey.
B.
Work authorized by any permit shall be completed within 60 days from
the date of issuance of said permit.
C.
In the event that said work is not completed within 60 days, said
permit shall thereon become invalid, and a new permit must be obtained.
D.
The fee for any permit required pursuant to this article shall be
$5 for each system installation.
A.
Any person, other than a corporation, violating any provision of
this article shall be liable for the first offense to a fine of not
less than $100 or more than $500 or to imprisonment for a period of
90 days, or both, and for the second and each succeeding offense,
a fine of not less than $500 or to imprisonment for a period of 90
days, or both. The amount of such fine and imprisonment, within the
limitation aforesaid, shall be determined at the discretion of the
Municipal Judge; and, in default of the payment of any fine imposed,
may be imprisoned for a period not exceeding 90 days.
B.
Any corporation violating any provisions of this article shall be
liable for the first offense to a fine of not less than $100 or more
than $500 and, for the second and each succeeding offense, a fine
of not less than $500, the amount of such fine, within the limits
aforesaid, to be determined at the discretion of the Municipal Judge.
A.
The Director of Public Safety or members of the Department of Public
Safety designated by the Director of Public Safety shall be charged
with the duty of enforcing this article.
B.
The authority having jurisdiction, enforcing this article, will have
the responsibility for making interpretations of provisions contained
therein for deciding upon the approval of equipment and materials
and for the arrangement of the smoke detection system.
C.
The aforementioned authority having jurisdiction may waive specific
requirements in this article or permit alternate methods, where it
is assured that equivalent objectives can be achieved by establishing
and maintaining safety.
Any existing multiple dwelling buildings consisting of four
or more dwelling units, having a fire-resistance rating of two hours
or more, and having enclosed interior stairways, shall be exempted
from the provisions of this article.
