A. 
There is hereby created and established in the government of the City of Hoboken a department that shall be known as the "Department of Community Development."
B. 
The Zoning Office, including, without limitation, the Zoning Officer, shall hereinafter be a Division of the Department of Community Development.
C. 
Within the Department of Community Development shall be a Division of Housing which shall be responsible for the supervision, maintenance, and development of housing within the City of Hoboken. The personnel staff in the Division of Housing may include clerical, operational, supervisory, and managerial positions as deemed necessary within the budgetary limits established by the Council.
D. 
The Rent Leveling Office shall hereinafter be a subdivision within the Division of Housing. This office shall be responsible for administering and enforcing the Rent Control Ordinance and the Rental Housing; Warehouse Ordinance in coordination with the Rent Leveling Board and under the supervision of the head of the Division of Housing and the Director of the Department of Community Development.
There is hereby assigned and transferred to said Department all the subordinate officers and employees in the Office of Waterfront Development in the City of Hoboken, the Zoning Office of the City of Hoboken, the Rent Leveling Office, and the Division of Housing, holding their offices and positions under tenure of office under any law of this state or Title 11A, Civil Service, of the revised statutes of New Jersey and now exercising and performing any of the functions, powers and duties in the offices.
There is hereby transferred and assigned to said department all of the property, books, papers and records relating to any of the offices and other governmental agencies hereinabove allocated and assigned to said department, except such books, papers and records as are now required by law or ordinances of the City of Hoboken to be kept in the office of some other officer or department of the city government.
There is hereby created the office of Director of the Department of Community Development. The Director shall be appointed by the mayor with the advise and consent of the Council and shall serve during the term of the mayor appointing him and until the appointment and qualification of his/her successor and shall be subject to removal as provided by law. Vacancies in the office of director shall be filled in the same manner as the original appointment but for the unexpired term only.
The Director shall be head of the department and, in addition to the functions, powers and duties that are hereby or may hereafter be conferred and imposed upon him/her by law and the ordinances of the City, shall:
A. 
Be responsible for the appointment and supervision of personnel employed therein.
B. 
Exercise supervision and have general responsibility for all the operations of said Department and of the personnel employed therein.
C. 
Supervise the organization of the department and changes in the organization thereof, and, to the extent to which the organization of the department is now prescribed by law, the Director may organize the Department into such divisions and bureaus and make such assignments as he may deem advisable, except that the officers and other governmental agencies and positions hereby allocated and assigned to said department shall be maintained.
D. 
Make recommendations to the council for the hiring of such outside consultants and contractors as are necessary for the operations of the department of community development.
E. 
Formulate and adopt, subject to the approval of the mayor, rules and regulations for the efficient conduct of the work and general administration of the department and the officers and employees thereof.
F. 
Have the power and authority to negotiate with and enter into agreements with public and private agencies as may become necessary for the operations of the department of community development.
G. 
Make periodic reports with such recommendations as deemed appropriate to the mayor and to the council concerning the affairs of the department.
The personnel staff in the Department of Community Development shall include a clerical staff position and such other necessary personnel within the budgetary constraints established by the Council.
All appropriations available or to become available to any department, office or other governmental agency, the functions, powers and duties of which are hereby assigned and transferred to said department, are hereby transferred to the department established hereby and shall be available for the objects and purposes for which appropriated.
