A.
A Municipal Court for the City of Hoboken is hereby established pursuant
to the New Jersey Statutes.
B.
The name of the Municipal Court shall be the "Hoboken Municipal Court."
C.
The Municipal Court shall have a seal that shall bear the imprint
of the name of the Court.
D.
The Municipal Court shall have, possess and exercise the functions,
powers, duties and jurisdiction conferred by the laws of the State
of New Jersey and by the New Jersey Court Rules.

There is hereby created the Office of Municipal Court Judge,
which shall consist of two Municipal Court Judges. Before the appointment
of a second Judge, the City shall obtain the consent of the assignment
Judge of Hudson County pursuant to N.J.S.A. 2B:-5.
One of the two Judges shall be designated the Chief Judge, who
will be responsible for all supervisory and administrative functions
of the Municipal Court. Each Municipal Court Judge shall be an attorney-at-law
of the State of New Jersey and shall be appointed by the Mayor with
the advice and consent of the City Council and for the term of three
years from the date of appointment and until a successor is appointed
and qualified. The salary of each Municipal Court Judge shall be fixed
by ordinance adopted.
A.
There is hereby created the unclassified position of Municipal Court
Director who shall be appointed by the Business Administrator without
a term. The Municipal Court Director shall direct the administrative
functions of the Municipal Court, including but not limited to the
Court Clerk's office and the Violations Bureau. The Municipal
Court Director shall also be responsible for all administrative and
financial functions of all sections of the Municipal Court.
B.
The Municipal Court Director shall be appointed by the Business Administrator,
on the basis of education and Municipal Court experience in all its
functions.
C.
The Municipal Court Director shall function under the direct supervision
of the Municipal Court Judge. The Municipal Court Director shall be
a managerial salaried position with a forty-hour work week.
There is hereby created the position of Municipal Court Administrator,
who shall serve as clerk to the Court under the supervision of the
Municipal Court Judge and the Municipal Court Director and shall be
appointed by the Business Administrator subject to the requirements
of the Department of Personnel of the State of New Jersey. The Municipal
Court Administrator shall be a supervisory position with a forty-hour
work week.
There is hereby created the position of Deputy Municipal Court
Administrator, who shall serve as a direct assistant to the Court
Administrator and shall function as Administrator in the event of
the Clerk's absence or disability. The Deputy Court Administrator
shall be appointed by the Business Administrator subject to the requirements
of the Department of Personnel in the State of New Jersey.
There is hereby created the position of Violations Clerk, who
shall supervise the Violations Bureau of the Municipal Court in the
processing of summonses and the collection of fines. The Violations
Clerk shall be responsible to the Municipal Court Director. The Violations
Clerk shall be appointed by the Business Administrator subject to
requirements of the Department of Personnel of the State of New Jersey.
Any new appointments to the position of Violations Clerk after the
adoption of this Article shall be a supervisory position with a forty-hour
work week.
There are hereby created the positions of Assistant Violations
Clerks, who shall serve as direct assistants to the Violations Clerk
and one of whom shall act as Violations Clerk in the absence or disability
of the Violations Clerk as assigned by the Municipal Court Director.
The Assistant Violations Clerks shall be appointed by the Business
Administrator subject to the requirements of the Department of Personnel
of the State of New Jersey.
There are hereby created the clerical positions of clerk, senior
clerk, clerk-typist, senior clerk-typist, cashier/clerk and account
clerk assigned to the Municipal Court. Said clerical staff shall be
appointed by the Business Administrator subject to the rules and regulations
of the New Jersey Department of Personnel and shall be assigned to
perform clerical functions in the Municipal Court as directed by the
Municipal Court Director. The clerical personnel shall be limited
by the budgetary constraints of the municipality.
A.
The Business Administrator may appoint an interpreter on a part-time
basis in accordance with the rules and regulations of the New Jersey
Department of Personnel to provide the Municipal Court with interpreting
services as required for the proper function of the Municipal Court.
Interpreters shall be evaluated by the Administrative Office of the
Courts.
B.
The Municipal Court Director may as part of the function of that
office provide the Municipal Court with services of interpreters of
language or hearing disability as required for the proper function
of the Municipal Court. Retaining and payment of said services shall
be done in accordance with the provisions of the Purchasing Ordinance
of the City of Hoboken.
The following persons employed or assigned in the Municipal
Court shall be assigned to the Department of Administration: Municipal
Court Director, Municipal Court Administrator, Deputy Municipal Court
Administrator, Violations Clerk, Assistant Violations Clerk, clerical
staff and interpreters. This assignment is for nonjudicial purposes
only, such as hours, compensation and other terms and conditions of
employment only, and budgetary matters. Nothing herein contained shall
be construed to assign the Municipal Court Judge to the Department
of Administration or any other Department. Nothing herein contained
shall be construed to vest in the Municipal Court Judge appointment
power within the Municipal Court or any other nonjudicial administrative
functions.
There is hereby transferred and assigned to the Municipal Court
all the property, books, papers and records relating to matters heretofore
in the Department of Administration of the City of Hoboken, including
the Municipal Court Administrator's records and the Violations
Clerk's records.
Sections 4-21 through 4-33, inclusive, of the Code of the City of Hoboken, dealing with the Municipal Court and personnel therein, are hereby repealed.
