Owners, agents of owners, managing agents and superintendents
shall each have the duties imposed by this chapter. No person shall
be relieved from any duty herein by reason of the fact that an occupant
or other person shall have the same or similar duties or shall have
failed to report a violation; nor shall any person be relieved of
liability by the terms of any lease or agreement.
Owners, agents, tenants and occupants shall place refuse only
in receptacles provided for disposal. Refuse shall not be thrown out
of windows or down dumbwaiters; nor shall refuse be placed on stairways
or fire escapes or in common hallways.
An occupant shall be liable for violations of this chapter to
the extent that he has the power to prevent a violation or assist
in abating a violation. Occupants shall be deemed to have the power
to abate a violation if the violation is caused by their own act or
the act of a member of their family or household or their guests.
