A. 
The Coordinator of the Division of Cultural Affairs of the Department of Human Services of the City of Hoboken or his/her designated agent shall be responsible for the issuance of permits to applicants for the exhibition and sale of arts and crafts items, food or other related items or services at art festivals and other cultural events sponsored by the City of Hoboken.
B. 
The following fees shall be imposed and collected by the Division of Cultural Affairs, the amount of which is dependent on deadline dates imposed for each specific event:

Artists, craftspersons and photographers

Local restaurants

Food vendors

Local nonprofit community groups

Holiday crafts show — City Hall

C. 
Permits shall be issued for sites designated by the Coordinator of the Division of Cultural Affairs and shall be valid only for the specific date(s) designated for specific events or for alternate dates (raindates) as determined by the Coordinator of the Division of Cultural Affairs.
D. 
The Coordinator of the Division of Cultural Affairs shall have the right to deny the issuance of or alternatively revoke a permit to any applicant whose goods, wares, services, foods or other items are not suitable for a particular event as well as the right to reject any applications or revoke a permit of any applicant seeking to display items that are obscene, sexually explicit, or likely to incite immediate violence.
E. 
It shall be the responsibility of the applicant or permit holder to ensure the lawfulness of his/her conduct as well as the lawfulness of the conduct of his/her employees and to ensure the clearing of all goods, merchandise and waste items from the area at the close of the day's event. Failure to comply with this subsection shall subject the applicant or permit holder to any and all applicable penalties imposed pursuant to local, state and federal laws.
F. 
Hours of operation of designated events shall be determined by the Coordinator of the Division of Cultural Affairs and, if otherwise required by the Hoboken Code, ratified and approved by the Municipal Council.
G. 
All restrictions set forth in §§ 168-44 through 168-47 of this City Code shall apply to all local retail merchants at all times including, but not limited to times when there are arts festivals and cultural events, street and/or sidewalk fairs sponsored by the City of Hoboken through the Department of Cultural Affairs or any other City agencies.

H. 
The local Police Department, the Zoning Officer and the Construction Official shall have the authority to enforce the above sections.

I. 
All noise ordinances as set forth in Chapter 133 of this City Code shall apply to all local retail merchants and street vendors at all times including, but not limited to times when there are arts festivals and cultural events, street and/or sidewalk fairs sponsored by the City of Hoboken through the Department of Cultural Affairs or any other City agencies.
