Vehicles and traffic — See Ch. 190.
The parking of vehicles or the abandonment of vehicles in violation
of any provision or section of this chapter shall be deemed a nuisance
and a menace to the safe and proper regulation of traffic in that
it constitutes danger to life, limb and property of other motorists,
pedestrians and others.
It shall be unlawful to park any trailer or semitrailer upon
any public street in the City while the trailer or semitrailer is
detached from a tractor.

When a vehicle is parked or abandoned in violation of any provision
or section of this chapter, members of the Police Division of the
City are hereby authorized to remove the vehicle from the street to
a garage designated or maintained by the Police Division or to a lot
designated or maintained by the Police Division used for the storage
of any such vehicle. Whenever a police officer removes a vehicle from
a street as authorized by law or any provision or section of this
chapter and the officer knows or is able to ascertain the name and
address of the owner thereof, such officer shall immediately notify
such owner, in writing, of the fact of such removal and reasons therefor
and the place to which such vehicle has been removed. If such vehicle
is moved to a public garage, a copy of such notice shall be given
to the proprietor of the garage. Whenever an officer removes a vehicle
from the street under this section and does not know and is unable
to ascertain the name of the owner, or if the owner fails or refuses
to claim the vehicle and the same remains in the possession of the
Police Division for a period of 30 days, the Police Division shall
expose the vehicle for sale at public auction in a public place pursuant
to N.J.S.A. 39:10.4.1 and 40:47.20.

Continuous parking of a vehicle on a public highway for a period
of 72 hours shall be prima facie evidence of abandonment by the owner
thereof and reasonable grounds for a member of the Police Division
to believe that such vehicle has been abandoned.
This chapter shall be deemed an exercise of the police power
of the Mayor and Council for the preservation and protection of public
safety, and its provisions shall be liberally construed with a view
to effecting such purpose.

Any owner or other person legally entitled to the return of
any vehicle removed by the Police Division shall be required to pay,
in addition to any fine that may be imposed under the terms of this
chapter, the full amount of fees chargeable for towing and storing
the vehicle before the return thereof. The amount of any unpaid fee,
the payment of which is required hereunder, shall constitute a debt
due the Mayor and Council of the City of Hoboken and shall be collectible
in the manner provided by law in a court of competent jurisdiction.
