As used in this chapter, the following terms shall have the
meanings indicated:
All premises on which are conducted one or any combination
of the following practices when done upon the scalp, face or neck
for cosmetic purposes and not for treatment of disease or physical
or mental ailments; and when done for payment, either directly or
indirectly, or without payment for the public generally; shaving or
trimming the beard or cutting the hair; applying facial and scalp
preparations, by hand or mechanical appliances; singeing, shampooing
or dyeing the hair or applying hair tonics; applying cosmetic preparations,
antiseptics, powders, oils, clays or lotions to the scalp, face or
neck. The term "barbershop" shall not include beauty shops limited
to the practice of hair and beauty culture catering to female persons
and as further defined in N.J.S.A. 45:4A-5.[1]

All barbershops shall be well lighted and ventilated, and their
furniture, equipment, tools, utensils, floors, walls and ceiling shall
be kept clean at all times.
It shall be unlawful to own, manage, operate or control a barbershop
except under the following conditions:
A.
No towel shall be used on any patron which has been used for another
patron until the towel is laundered and thoroughly dried, and no towel
which has been placed in a steamer or sterilizer shall be used on
any patron.
B.
There shall be readily available in a barbershop, school or college
an adequate supply of hot and cold water. Where a public water supply
under pressure and a sewerage system are available, there shall be
provided in the barbershop a supply of hot and cold running water
under pressure.
C.
The headrest of a barber chair shall be covered with a clean towel
or paper covering before use.
D.
A clean towel or other clean material shall be placed about the neck
of a patron to prevent hair from touching the skin of the patron.
E.
Any tools or parts thereof which come into contact with the head,
face or neck of the patron, such as razors, scissors, tweezers, combs
and parts of vibrators, shall be immersed in boiling water or in alcohol
of a strength of 70% or higher or treated by some other equally effective
method before being used.
F.
Shaving mugs and shaving brushes shall be thoroughly rinsed in hot
water immediately before use.
G.
At least two receptacles for soiled towels and waste shall be provided.
Only used towels shall be deposited in one and wastes, such as used
shaving paper, shall be deposited in the other.
H.
No styptic pencil, fingerbowl, sponge, lump alum or powder puff shall
be used, except the individual applicator type.
I.
No room used as a barbershop shall be used as a sleeping room nor
be located in any sleeping room, feed store, restaurant or lunchroom,
unless separated therefrom by a substantial partition extending from
floor to ceiling.
J.
There shall be at least 78 square feet of floor space in every barbershop
having one barber chair and there shall be at least 60 square feet
of floor space for each additional barber chair.
K.
Any barbershop maintaining toilet facilities for public use shall
maintain these facilities in a clean and sanitary condition.
L.
While serving patrons, attendants shall wear clean outer garments.
M.
Immediately before serving a patron, attendants shall thoroughly
wash their hands with soap and water.
N.
No common drinking cup or glass shall be kept or used.
O.
All premises shall be subject to such conditions, restrictions and
rules and regulations as the Division of Health may see fit to impose
in order to protect the health of the Borough.
A.
No barbershop shall open for business earlier than 8:30 a.m. nor
close later than 6:00 p.m. throughout the year, except on Saturdays
and the day preceding New Year's Day, Washington's Birthday,
Decoration Day, July 4th, Labor Day, Thanksgiving Day and Christmas
Day, when they shall close not later than 7:00 p.m.
B.
All shops shall remain closed on the above-mentioned legal holidays,
Sundays and Mondays, except the Mondays of the weeks in which the
above-mentioned legal holidays occur.
C.
During the hours and on the days when barbershops are closed, the
entire interior of the shop shall be open to full view from the public
street, and no other business shall be conducted in the shop during
the hours and on the days when the barbershops are closed.
