Pursuant to Section 11 of the Uniform Fire Safety Act, N.J.S.A.
52:27D-192 et seq., the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1
et seq.) shall be locally enforced in the Township of Fredon.
The local enforcing agency shall be the Office of the Fire Marshal
for the County of Sussex.
A.
Within the established boundaries of the Township of Fredon, the
local enforcing agency shall enforce the Uniform Fire Code in all
buildings, structures, and premises other than owner-occupied buildings
of less than three dwelling units used exclusively for dwelling purposes
and buildings, structures, and premises owned or operated by interstate
agencies or the state.
B.
The local enforcing agency shall faithfully comply with all the pertinent
requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
A.
The Office of the County Marshal referenced in § 262-2 shall be as created and supervised by the County of Sussex and shall meet all of the requirements of the applicable law and regulations.
B.
Appointment of Fire Marshal. The Fire Marshal of the Office of the
Fire Marshal of the County of Sussex shall be a state-certified fire
official appointed by the Freeholders of the County of Sussex consistent
with the procedures set forth in the applicable law and regulations.
The Sussex County Freeholders may appoint inspectors and other employees
of the enforcing agency consistent with the applicable laws and regulations.
All life-hazard use inspectors shall be certified by the state.
The Office of the Fire Marshal of the County of Sussex referenced in§ 262-2 shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of the New Jersey Department of Community Affairs.

A.
Certificate
of compliance is required. Every property owner in the Township of
Fredon of a building or structure of Use Groups R-3 and R-4, as defined
by the Uniform Fire Code (which includes attached and detached townhouses,
one- and two-family dwellings, and mixed-use buildings with two or
less residential units), must obtain a certificate of smoke detector
and carbon monoxide compliance (“certificate of compliance”)
prior to a change in occupancy or ownership due to sale, resale, long-term
(over 175 days) rental or re-rental. Short-term rentals, such as Vrbos
or Airbnbs, are required to have an annual smoke detector compliance
inspection to be scheduled each December.
B.
Inspection.
Every property owner requiring a certificate of compliance shall:
i) request an inspection by the Township of Fredon on the designated
form; ii) pay the required inspection fee; iii) provide entry to the
dwelling or dwelling unit and any assistance as may be required by
the inspector. The Fredon Volunteer Fire Department shall conduct
the inspection upon receipt of the inspection request and collect
the fee upon time of inspection. If the inspection reveals compliance
with the smoke detector and carbon monoxide alarm requirements as
set forth in N.J.A.C. 5:70-4.19, or its successor regulation, and
the requirement for a portable fire extinguisher as required by N.J.S.A.
52:27D-198.1 et seq., or its successor statute, then the property
owner shall be issued a certificate of compliance.
A.
In addition to the registrations and permits required by the Uniform
Fire Code, all other uses subject to Uniform Fire Code inspections
shall register with the Office of Fire Marshal, County of Sussex.
These uses shall be inspected once per year and shall pay an annual
fee as set forth by the County of Sussex, which schedule(s) of fees
are adopted by reference for application within the Township of Fredon.

B.
Uses requiring registration with the state as life hazard uses shall
not be required to register or pay fees pursuant to this section.
C.
Vacant buildings that create a fire hazard shall be charged and inspected
according to the applicable schedule of fees.
D.
Owners of more than one use at a given location shall pay a full
fee for the largest use and 1/2 fee or fees for any other use or uses.

A.
SNOW COVERAGE
Definitions. As used in this section, the following terms shall have
the meanings indicated:
The coverage of the fire hydrant or stand pipe as a result
of natural precipitation or street-clearing activities.
B.
Property owner and/or homeowners' association responsible for clearing
fire hydrants and stand pipes. It shall be the responsibility of the
homeowners' association whose property contains any fire hydrants
or stand pipes to clear such hydrants or stand pipes of snow within
12 hours of the end of any snow coverage of such hydrants or stand
pipes.
C.
Violation; penalty. If the homeowners' association any property owner fails to comply with the requirements of Subsection B, the Township may in its discretion perform the clearance and bill the responsible property owner and/or homeowners' association up to $75 per hydrant or stand pipe for the service.
E.
Severability. The various parts, sections, and clauses of this section
are declared to be severable if any part, sentence, paragraph, section
or clauses are judged unconstitutional or invalid by a court of competent
jurisdiction.
F.
This section shall take effect as required by law.
The application fees for the permits listed in N.J.A.C. 5:70-2.7
shall be specified in the Uniform Fire Code.
Pursuant to N.J.S.A. 52:27D-206b and 208d, any person aggrieved
by any action of the local enforcing agency shall have the right to
appeal to the Uniform Construction Code Board of Appeals of the County
of Sussex.
Enforcement, violations, and penalties shall be managed in conformity
with the Uniform Fire Safety Act, the Uniform Fire Code and all other
laws of the State of New Jersey.
