[HISTORY: Adopted by the Township Committee of the Township of Fredon Ord. No. 7-88 (Sec. 3-8 of the 1972 Revised General Ordinances). Amendments noted where applicable.]
For the purposes of this chapter, the following terms shall have the meanings indicated:
GENETICALLY ENGINEERED MICROORGANISM
A living microorganism, including, but not limited to, bacteria and virus whose genes have been artificially altered for scientific or commercial purposes.
No person or entity shall release any genetically engineered microorganisms into the outdoor environment within the Township of Fredon as part of any field tests, experiment or research project, or for any other reason, without first having obtained a permit issued by the Township Committee, after public hearing.
The Township Committee shall adopt, by resolution, such rules and regulations which shall, in its discretion, be deemed reasonable and necessary governing the application for permission to release any genetically engineered microorganism into the outdoor environment of the Township, including, but not limited to, regulations requiring completion of appropriate applications; submission of a plan for environmental protection, containment and disposal; submission of a plan insuring the health, safety and welfare of the public; submission of approvals by appropriate state and federal governmental agencies; payment of fees and costs to the Township; survey and location of the release site and affected areas; and posting of appropriate sureties or other insurances to guarantee against liability for damage or loss.

Any person or entity who violates this chapter shall be liable for penalties in accord with the schedule shown in § 1-3. If the violation is of a continuing nature, each day during which it continues constitutes an additional, separate and distinct offense under this chapter.
