By authority of the resolution adopted by the Board of Trustees on the seventh day of May 1962, pursuant to the provisions of Article 7 of the Village Law, the Planning Board of the Village of Liverpool is empowered and authorized to approve plats within the Village of Liverpool.
The purpose of this chapter is to provide for orderly, efficient growth within the community and to afford adequate facilities for the transportation, housing, comfort, convenience, safety, health and welfare of its population pursuant to the following objectives:
A. 
Land to be subdivided and developed shall be of such character that it can be used safely for building purposes without danger to health or safety, or peril from flood or other menace.
B. 
Provisions shall be made for adequate water supply, drainage, sewerage and other needed improvements and utilities according to acceptable engineering principals.
C. 
Proposed development shall be designed in harmony with the development pattern of adjacent properties.
D. 
Development shall be provide for adequate fire and emergency services access and fire hydrants for fire protection.
E. 
Provisions shall be made for protection of natural drainage and significant historical and/or environmental features.
A. 
This Subdivision Review Chapter shall be administered by the Planning Board to ensure orderly growth and development and shall supplement and facilitate provisions of Chapter 380, Zoning, Official Map and adopted land use plans.
B. 
When necessary to further its purposes, this chapter shall be amended by the Board of Trustees, subject to a public hearing to review amendments.
Application filing, consulting, environmental quality review, inspection, fixed or other reasonable fees sufficient to recover cost incurred by the Village of Liverpool may be charged. Such fees shall be set by resolution of the Board of Trustees.
A. 
It shall be the duty of the Code Enforcement Officer to enforce the provisions of this chapter and to bring to the attention of the Board of Trustees any violations or lack of compliance.
B. 
Any violation by a person, firm or corporation of any provision of this chapter shall be deemed a violation punishable as provided in § 380-128 of the Code of the Village of Liverpool, or by a civil penalty of $100.
C. 
Any person who takes part in or assists in any violation of this chapter shall also be subject to the penalties provided herein.
D. 
Each day that a violation of this chapter is committed or permitted to exist shall constitute a separate offense.
E. 
The Board of Trustees shall have recourse to such remedies in law and equity as may be necessary to ensure compliance with the provisions of these regulations.
A. 
In their interpretation and application, the provisions of this chapter shall be held to be the minimum requirements. More stringent provisions may be required if it is demonstrated that different standards are necessary to promote public health, safety and welfare.
B. 
Where the conditions imposed by any provisions of this chapter are either more restrictive or less restrictive than comparable conditions imposed by any other provisions of this chapter or any other applicable law, ordinance, resolution, rule or regulation of any kind, the regulations which are more restrictive and impose higher standards or requirements shall govern.
