The Fire Department of the City of Gardner shall consist of a Fire Chief, a Fire Captain, six Lieutenants, and such fire privates and other support personnel as the Mayor, with the approval of the City Council, shall from time to time deem necessary, subject to appropriation.
Subject to the following, all appointments to the Fire Department shall be made by the Fire Chief.
A. 
The Fire Chief shall be appointed by the Mayor, subject to confirmation by the City Council, and shall be the head of the Fire Department, and shall have full and absolute control and command of the Department, its firefighters and members and other officers when engaged in the fire service of the City, or when assigned by him to any special duty. The Chief shall also have control of all City property used by the Fire Department and shall have all other authorities and responsibilities as provided by law.
B. 
The Chief shall be appointed for a term of three years, shall be exempt from the provisions of Chapter 31 of the General Laws in accordance with Chapter 284 of the Acts of 2012 providing for such exemption, and shall meet such minimum qualifications for said position as the Mayor, with the approval of the City Council, shall from time to time establish.
The compensation for the position of Fire Chief shall be as set forth in the Code of the City of Gardner as from time to time amended.[1]
