A.Â
There shall be established in the City of Gardner a Law Department
to be administered by the City Solicitor with the assistance of an
Assistant City Solicitor. Both said officers shall be members of the
Bar of the Commonwealth of Massachusetts in good standing.
B.Â
The City Solicitor shall be appointed as provided by the provisions
of Section 6 of the City Charter. The Assistant City Solicitor shall
be appointed by the Mayor, subject to confirmation by the City Council,
for a term of one year. Said City Solicitor and Assistant City Solicitor
may be removed from office as provided by Section 8 of the City Charter.

The duties of the City Solicitor and Assistant City Solicitor
shall be as follows. They shall:
A.Â
Approve contracts, give legal advice and furnish written opinions
when so requested by the Mayor, City Council, the chairperson of a
City committee or the head of any City department.
B.Â
Prosecute or defend all cases and proceedings to which the City is
a party.
C.Â
Prepare or approve all deeds or other legal instruments relating
to the City, consider claims against the City and make recommendation
for their resolution to the Mayor or appropriate committee of the
City Council, as the case may be, and generally handle all legal affairs
pertaining to the City.
D.Â
Employ and supervise, from time to time, such full- or part-time
assistance as may be required to accomplish the above duties, subject,
however, to proper appropriations being made therefor.
