No hawker and/or peddler, even though duly licensed otherwise, shall operate within the City of Gardner on Sundays, legal holidays or on such legal holidays which fall on Sundays and are celebrated on the following day, nor shall any hawker and/or peddler, with the exception of those peddlers who travel previously established routes and are duly licensed under either a county, City or state license, operate on the following streets or on property adjoining said streets on any day of the week: Central, Main, Pleasant to the junction of Willow, Connors to Baker, Parker to Nichols, Chestnut, or City Hall Avenue unless such hawker and/or peddler shall have first obtained a written permit for the same from the Police Department. No such permit shall be issued by the Police Department unless application or request for the same is made a minimum of 10 calendar days prior to such Sunday or holiday for which permission is requested. Such permits shall be issued only when in the opinion of the Chief of Police or his designee public interest and/or convenience will be served by such issuance. The City Council, by majority vote, may waive any of the restrictions in this section for a special event.

No hawker and/or peddler, even though duly licensed otherwise, shall operate within 1,000 feet of any school, playground, or park within the City of Gardner on any day of the week.
A. 
The School Committee, by majority vote, may waive the one-thousand-foot requirement for hawkers and peddlers on or around school property if it deems public interest and/or convenience will be served.
B. 
Licensed hawkers and peddlers may operate within 1,000 feet of a park or playground on any day of the week upon written approval of the Director of Public Works, if the Director deems that public interest and/or convenience will be served.

All hawkers and/or peddlers, with the exception of those peddlers who travel previously established routes and are duly licensed under either a county, City or state license, on each visit to the City of Gardner for the purpose of offering goods for sale, shall, prior to operating within the limits of the City of Gardner, present themselves to the police at the police station for examination as to their licenses and as to the goods to be offered for sale. If found by the police to be duly licensed, and the goods to be offered for sale are not prohibited by law to be sold, the Police Department shall issue a card stating that such examination has been made, whereupon the hawker and/or peddler may, subject to this article, then operate within the limits of the City of Gardner.

Events sponsored and put on by the City of Gardner shall be exempt from the provisions of this chapter.
Any person convicted of a violation of this article shall be punished by a fine not exceeding $20 for each offense.
