No person, corporation or public utility shall commence any underground construction or repairs on or within the limits of public ways and sidewalks located in the City of Gardner without prior written approval of the Director of Public Works or his designee. Such approval shall not be given by the Director without consulting with the Survey Department and notifying the Public Service Committee of the action taken.
Any person, corporation or public utility who or which fails to obtain written approval as set forth in § 567-15 hereof and who commences such underground construction prior to such approval shall, upon conviction of such violation, be punished by a fine not to exceed $200. Each day of continuing violation shall be considered a separate offense for all purposes hereunder. The Police Department of the City of Gardner shall be the enforcement authority for this article.
This article shall not be deemed to abridge or limit any provisions of the General Laws or state regulations with respect to other requirements for underground construction but rather shall be considered as supplemental to such requirements.
All repair of underground construction sites shall be made pursuant to the specifications and regulations available from the City Engineer's office.
