A. 
Words and phrases defined. Whenever any words and phrases are used in this article, the meaning respectively ascribed to them in Subtitle I of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.
B. 
Additional definitions. As used in this article, the following terms shall have the meanings indicated:
PARKING LOT, PUBLIC
All areas, lots or facilities owned, operated or conducted by the Parking Authority and used for public parking.
PARKING METER
Any mechanical device or meter not inconsistent with this article placed or erected for the regulation of parking by authority of this article. Each parking meter installed shall indicate by proper legend the legal parking time established by the City, and when operated shall at all times indicate the balance of legal parking time and at the expiration of such period shall indicate illegal or overtime parking.
PARKING METER SPACE
Any space within a parking meter zone adjacent to a parking meter and which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the curb or on the surface of the street or parking lot adjacent to a street and adjacent to or adjoining the parking meters.
PARKING METER ZONE
Any restricted street or parking lot contiguous to a street upon which parking meters are installed and in operation.
A. 
On-street. Parking meter zones are hereby established in and upon the streets or parts of streets named in Schedule I attached to and made a part of this article.
B. 
Off-street. Parking meter zones are hereby established in and upon the off-street parking area described below, where parking will be permitted for a period not exceeding 180 minutes:
(1) 
38th – 39th Streets. All that certain lot, tract or parcel of land and premises, hereinafter particularly described, situate, lying and being in the City of Union City, in the County of Hudson and State of New Jersey: Beginning at a point in the northeasterly side of 38th Street (formerly Lewis Street) distant 96.74 feet northwesterly from the corner formed by the intersection of the northeasterly side of 38th Street with the northwesterly side of Bergenline Avenue and from the point of beginning running thence (1) north 30 degrees 44 minutes 33 seconds east 200 feet to a point in the southerly side of 39th Street; thence (2) north 59 degrees 15 minutes 20 seconds west and along the southerly side of 39th Street 150 feet to a point; thence (3) south 30 degrees 44 minutes 33 seconds west 100 feet to a point; thence (4) north 59 degrees 15 minutes 27 seconds west 5.50 feet to a point; thence (5) south 30 degrees 44 minutes 33 seconds west 100 feet to a point in the northerly side of 38th Street; thence (6) south 59 degrees 15 minutes 27 seconds east and along the northerly side of 38th Street 155.50 feet to the point or place of beginning.
(2) 
36th – 37th Streets.
(a) 
All that certain tract or parcel of land and premises, hereinafter particularly described, situate, lying and being in the City of Union City, County of Hudson and State of New Jersey.
(b) 
Beginning at a point in the northerly side of 36th Street (formerly Blum Street) the point being distant 191.08 feet westerly from the intersection of the northerly side of 36th Street, and the westerly side of Bergenline Avenue and running thence; (1) north 58 degrees 58 minutes 27 seconds west and along the northerly side of 36th Street, 200 feet to a point, the point being the southwesterly corner of hereinbefore mentioned Lot 17, thence (2) north 29 degrees 52 minutes 33 seconds east along and beyond the westerly side of Lot 17 149.54 feet to a point in the southerly side of 37th Street, formerly known as Union Street, thence (3) South 58 degrees 35 minutes 27 seconds east and along the southerly side of 37th Street, 206.14 feet to a point, the point being in the northeasterly corner of hereinbefore mentioned Lot 52, thence (4) south 32 degrees one minute 24 seconds west and along the easterly side of the Lot 52, 75 feet to a point, thence (5) north 58 degrees 35 minutes 27 seconds west 3.33 feet to a point, the point being the northeasterly corner of hereinbefore mentioned Lot 24, thence (6) south 29 degrees 52 minutes 33 seconds west and along the easterly side of the aforesaid Lot 24, 73.20 feet to the point or place of beginning.
(3) 
35th – 36th Streets. All those certain lots, tracts or parcels of land lying and being in the City of Union City, County of Hudson and State of New Jersey, which on a certain map on file in the Hudson County Register's Office entitled Assessment Map of the City of Union City, Hudson County, New Jersey, 1899, is known and designated as Lots 28, 29, 30, 31, 32, 33, 62, 63, 64, 65, 66 and 67 in Block 21 and more particularly described as follows: Beginning at a point in the northerly side of 35th Street (formerly Jefferson Street) distant 189.55 feet westerly from the intersection of the westerly side of Bergenline Avenue and the northerly side of 35th Street, the point being the southeasterly corner of hereinbefore mentioned Lot 33, and running, thence (1) north 58 degrees 58 minutes 27 seconds west and along the northerly side of 35th Street 150 feet to a point, the point being the southwesterly corner of Lot 28 thence (2) north 29 degrees 48 minutes 33 seconds east and along the westerly side of Lot 28 and 62, 200 feet to a point in the southerly side of 36th Street (formerly Blum Street) thence (3) south 58 degrees 58 minutes 27 seconds east and along the southerly side of 36th Street 150 feet to a point, the point being the northeasterly corner of Lot 67, thence (4) south 29 degrees 48 minutes 33 seconds west and along the easterly side of Lots 67, and 33,200 feet to the point or place of beginning.
(4) 
41st – 42nd Streets.
(a) 
All that certain lot, tract or parcel of land lying and being in the City of Union City, County of Hudson and State of New Jersey, which on a certain map on file in the Hudson County Register's Office entitled Map of City of Union City, Hudson County, New Jersey, 1899, is known and designated as Lots 21, 22, 23, 51 and 52 in Block 47 and more particularly described as follows: Beginning at a point in the southerly side of 42nd street (formerly Liberty Street) the point being distant 100 feet westerly from the intersection of the southerly side of 42nd street and the westerly side of Bergenline Avenue, running thence (1) southerly and parallel to the westerly side of Bergenline Avenue 100 feet to a point thence (2) westerly and parallel to the southerly side of 42nd Street, 25 feet to a point; thence (3) southerly and parallel to the first course 100 feet to a point in the northerly side of 41st Street, formerly known as Humboldt Street, the point being distant 125 feet westerly from the intersection of the northerly side of 41st Street and the westerly side of Bergenline Avenue; thence (4) westerly and along the northerly side of 41st Street, 75 feet to a point; thence (5) northerly and parallel to the first course, 100 feet to a point, thence (6) easterly and parallel to the northerly side of 41st Street, 50 feet to a point; thence (7) northerly and parallel to the first Course 100 feet to a point in the southerly side of 42nd Street; thence (8) easterly and along the southerly side of 42nd Street, 50 feet to the point or place of beginning.
(b) 
The ingress and egress for the off-street parking area are shown on the plans of the parking areas which are annexed and made a part of this article.
(5) 
Additional off-street parking facilities. Any and all additional off-street parking facilities owned or operated by the City parking authority.
A. 
On street.
(1) 
When a parking space in any parking meter zone is parallel with the adjacent curb or sidewalk, any vehicle parked in the parking space shall be parked so that the foremost part of the vehicle shall be nearest to the parking meter; when a parking space in any parking meter zone is diagonal to the curb or sidewalk, any vehicle parked in the parking space shall be parked with the foremost part of the vehicle nearest to the meter.
(2) 
Nothing contained in this article shall be construed to permit parking of vehicles in those spaces within any zone in which, by other regulations of the City, parking is prohibited; nor shall anything contained in this article be construed as prohibiting the City from providing free parking spaces for loading and unloading, for bus stops, taxicab stands or for other matters of a similar or emergency nature.
(3) 
It shall be unlawful for any person to deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this article.
B. 
Off street.
(1) 
Parking meters shall be so constructed and installed as to conform to the provisions of § 284-17, except that parking time shall be restricted to a period not to exceed 180 minutes in the off-street zones.
(2) 
No truck, tractor, trailer or vehicle in excess of 2 1/2 tons gross weight, whether moved by motor, human or animal power, shall park in or use any parking area owned, operated or maintained by the Authority. Trucks up to 2 1/2 tons gross weight, whether having commercial or passenger registration, may park in a parking area owned, operated or maintained by the Authority with the permission of and at the discretion of the Authority.
(3) 
No vehicle shall be parked in these areas when it does not fit between the lines designated as a single parking meter unit.
(4) 
No vehicle not equipped with pneumatic tires properly inflated shall park in or use any parking area owned, operated or maintained by the Authority.
(5) 
The municipal parking areas shall not be used as through streets, but shall be used only ancillary or incidental to the parking of vehicles or moving of vehicles on, to or from these parking areas.
(6) 
Upon payment to the Authority of a fixed fee not exceeding $40, a person shall be permitted to park a designated vehicle in a public parking area for a period of one month or a major fraction thereof.
(a) 
Upon acceptance of the fee the Authority shall issue to the applicant a sticker, sign, permit or meter cover for a meter installed at the designated area to permit the parking of his vehicle for a calendar month. A vehicle bearing a sticker, sign or permit, during the calendar month shown thereon, may park in the public parking area adjacent to the covered meter. The authority is extended the right to reasonably limit the extent of monthly parkers in the public parking areas. No other person is to park any car or vehicle contrary to the time permitted in a public parking area on Sundays or the legal holidays named.
(b) 
It shall be unlawful for any person to park or permit a vehicle to be parked or remain in a public parking area at any time, except within the hours specified on the legend attached to each meter and parking signs in the public parking area adjacent to the covered meter without a sticker, sign or permit.
(c) 
No vehicle shall be parked on a public parking area between the hours of 9:30 p.m. and 8:00 a.m. on any day without a sticker, sign or permit, and without being entitled to park adjacent to a covered meter by reason of his having prepaid the monthly fee fixed by the Authority.
A. 
Sixty-minute parking meter zones. Parking meter zones are hereby established which are restricted to sixty-minute metered parking periods, as described in Schedule II attached to and made a part of this article. Each parking meter installed in this metered zone shall be set to show or display a signal showing legal parking for the space alongside for a period not exceeding 60 minutes, upon deposit therein of coins of the United States of America at the rate of $0.25 for each thirty-minute period in accordance with the directions appearing on the legend affixed to the meter.
B. 
One-hundred-and-twenty-minute parking meter zones. Parking meter zones are hereby established which are restricted to one-hundred-and-twenty-minute metered parking periods as described in Schedule III attached to and made a part of this article.
C. 
Twelve-hour parking meter zones. Those streets which border on the Tunnel Cut are hereby established as twelve-hour parking meter zones and described in Schedule IV, attached to and made a part of this article, parking shall be permitted for a period not exceeding 12 consecutive hours. Each parking meter installed in the metered zone shall be set as to show or display a signal showing legal parking for the space alongside for a period not exceeding 12 consecutive hours, upon deposit therein of coins of the United States of America at the rate of $0.25 for each thirty-minute period in accordance with the directions appearing on the legend affixed to the meter.
A. 
Daily; certain hours. The hours of metered legal parking on the streets or parts of streets as described in Schedule V, attached to and made a part of this article, shall be 9:00 a.m. to 6:00 p.m., every day except Sundays and legal holidays.
B. 
Certain days; certain hours. The hours of metered legal parking on the streets or parts of streets as described in Schedule VI attached to and made a part of this article shall be 9:00 a.m. to 9:30 p.m., Monday, Thursday and Friday; 9:00 a.m. to 6:00 p.m., Tuesday, Wednesday and Saturday; 9:00 a.m. to 9:30 p.m., every day except Sundays three weeks before Christmas.
C. 
Certain days; certain hours; additional. The hours of metered legal parking on the streets or parts of streets as described in Schedule VII, attached to and made a part of this article, shall be 9:00 a.m. to 9:00 p.m., Monday, Thursday and Friday; 9:00 a.m. to 6:00 p.m., Tuesday, Wednesday and Saturday; 9:00 a.m. to 9:30 p.m., every day except Sundays three weeks before Christmas.
A. 
Meters required. Parking meters shall be installed in all zones established as parking meter zones in this article, provided that no parking meters shall be installed in any of the areas where parking is prohibited by statute pursuant to N.J.S.A. 39:4-138.
B. 
Placement and setting of meters. Parking meters installed in the parking meter zones established as provided in this article shall be placed upon the curb immediately adjacent to the parking places as described. Each parking meter shall be set to display by a signal that the parking space adjacent to the meter is or is not legally in use. Each parking meter shall be set to display a signal showing legal parking for the space alongside the meter for a period not exceeding 120 minutes, upon the deposit therein of a twenty-five-cent coin of the United States of America for each 30 minutes, in accordance with the directions appearing on the legend affixed to the meter and for a time not to exceed 60 consecutive minutes set in operation. The timing mechanism on the meter shall not permit a vehicle to be parked in the zone beyond two consecutive 60 minute periods.
C. 
Legal parking time indicator. Each parking meter installed shall indicate by a proper legend the legal parking time established by the City, and when operated shall indicate on its dial and pointer the duration of the periods of legal parking, and on the expiration of such period shall indicate illegal overparking.
D. 
Time limits; prohibitions.
(1) 
When a vehicle is parked in a space adjacent to a parking meter, the operator of the vehicle shall immediately deposit or cause to be deposited a twenty-five-cent coin of the United States, in the parking meter for each 30 minute period in accordance with the directions appearing on the legend affixed to the meter and for a time not to exceed 60 consecutive minutes. Failure to move the vehicle from the parking area after the expiration of the legal limit for the zone shall constitute a violation of this article. The timing mechanism on the meter shall not permit a vehicle to be parked in a zone beyond two consecutive 60 minute periods. Notice of this restriction shall be affixed prominently to each parking area when such restriction is in effect.
(2) 
It shall be a violation of the provisions of this article to deposit or cause to be deposited in any parking meter any slug, device or substitute for any coin of the United States.
E. 
Designation of spaces. The Director is instructed to have markings placed upon the curb and the street adjacent to each parking meter for the purpose of designating the parking space for which the meter is to be used, and each vehicle parked adjacent to any parking meter shall park within markings so established. It shall be unlawful to park any vehicle across any such marking or to park any vehicle in a position that shall not be entirely within the area so designated by such markings.
A. 
Reporting of violations. It shall be the duty of the police officers to inspect and check the use of parking meters and to note and record the following:
(1) 
The number of each parking meter which indicates that the vehicle occupying the parking space adjacent to such parking meter is or has been parked in violation of any of the provisions of this article.
(2) 
The state license number of the vehicle.
(3) 
Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending the violation.
B. 
Notice; penalty. Each police officer shall also attach to the vehicle a notice to the owner that his/her vehicle has been parked in violation of a provision of this article and instructing the owner to report to the Municipal Court in regard to the violation. Each owner, within the time prescribed by law, may pay to the Municipal Court, as a penalty and in full satisfaction of such violation, the sum of $10. The failure of the owner to make this payment at the Municipal Court within 48 hours, exclusive of Sundays and legal holidays, shall render the owner subject to the penalties provided for violation of the provisions of this article.
C. 
Serial numbering of notices; report to Board of Commissioners. The report and notice referred to in this section shall bear corresponding serial numbers, and all reports issued hereunder shall be accounted for by the respective police officers to the Municipal Court, and the Municipal Court shall render written report thereof to the Board of Commissioners once a month or as often as the Board shall require.
D. 
Towing away. In the event an operator shall fail to move his/her vehicle after the expiration of the legal parking period, the vehicle shall be deemed to be illegally parked within the parking zone and may be taken into possession by the City, towed to some proper storage place and where not released until the penalty provided in § 284-18 is paid, and until all reasonable towing and storage charges are paid. The City, its agents or employees shall not be responsible or liable in any manner for damages incurred in the towing, storage, possession or disposition of any vehicle.
A. 
Provisions covered by state statute. For any violation of any portion of this article the enactment of which derives its authority from N.J.S.A. 39:4-197, the penalty shall be a fine not to exceed $50 or imprisonment for a term not exceeding 15 days, or both.
B. 
All other provisions. For all other violations of this article the penalties shall be as provided in Chapter 1, Article IV, General Penalty.
