Editor's Note: The Sewer Authority was originally incorporated as the "Shiloh Sewer Authority." In 1977, the name was changed to "West Manchester Township Sewer Authority" when the Township gave the Authority responsibility for financing sewer projects throughout the Township.
The Board of Supervisors of the Township of West Manchester, York County, Pennsylvania, hereby signifies its intention and desire to organize an authority under the provisions of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," its amendments and supplements,[1] For the purpose of exercising any and all powers conferred by said Act.

The Chairman of the Board of Supervisors and the Secretary of the Township hereby are authorized and directed to execute, on behalf of this Township, Articles of Incorporation for said Authority, in substantially the following form:
ARTICLES OF INCORPORATION
To the Secretary of the Commonwealth of Pennsylvania:
In compliance with the requirements of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," as amended and supplemented,[1] and pursuant to an ordinance adopted by the municipal authorities of the Township of West Manchester, York County, Pennsylvania, expressing the intention and desire of the municipal authorities of said municipality to organize an authority under said Act, said municipality hereby does certify:
1.
The name of the Authority is the "Shiloh Sewer Authority."
2.
Said Authority is formed under the provisions of the Act of May 2, 1945, P.L. 382, known as the "Municipality Authorities Act of 1945," as amended and supplemented.
3.
No other Authority has been organized under said Municipality Authorities Act of 1945, as amended and supplemented, or under the Act of June 28, 1935, P.L. 463, as amended, and is in existence in or for the incorporating municipality except as follows:
(a)
The West Manchester Township Authority, organized by West Manchester Township on June 27, 1950.
(b)
York Regional Refuse Authority, organized jointly by the City of York, the Boroughs of West York and North York and the Townships of Spring Garden, Springettsbury and West Manchester on June 24, 1958.
4.
The name of the incorporating municipality is the Township of West Manchester, York County, Pennsylvania.[2]

Editor's Note: Original Sections 5 and 6 of the Articles of Incorporation, which included the names and addresses of the Township officials and the original members of the Authority, respectively, and which immediately followed this section, were deleted 11-14-1991 by Ord. No. 91-09.
The Chairman of the Board of Supervisors and the Secretary of the Township further are directed to cause a notice of the substance of this article, including the substance of the above Articles of Incorporation, and the proposed filing of the above Articles of Incorporation to be published once a week in a newspaper published and of general circulation in the County of York, Pennsylvania, and once in the York Legal Record, all as required by said Municipality Authorities Act of 1945, as amended and supplemented.[1]

The Chairman of the Board of Supervisors and the Secretary of the Township further are directed to cause said Articles of Incorporation, together with the necessary proofs of publication, to be filed with the Secretary of the Commonwealth of Pennsylvania and to do all other acts and things necessary or appropriate to effect the incorporation of the Shiloh Sewer Authority, including the payment of any filing fees in connection therewith.[1]

The adoption of this article is deemed necessary for the benefit and preservation of the public health, peace, comfort and general welfare of, and will increase the prosperity of, the people of the Village of Shiloh, West Manchester Township, York County, Pennsylvania.
