The owner, occupant or tenant of every property fronting upon or alongside of any of the streets and highways in West Manchester Township is hereby required to remove or cause to be removed from all sidewalks in front of or alongside of such property sufficient snow and ice to leave a cleared pathway at least 24 inches in width for the entire length of that portion of sidewalk in front of and alongside of said property, said pathway to run parallel to the curb or building line of said sidewalk within eight hours after the same shall have ceased to fall or form, provided that:
A. 
Where a sidewalk is less than 24 inches in width, sufficient snow and ice shall be removed within said time to leave a cleared pathway wide enough to permit one pedestrian at a time to pass thereover.
B. 
Snow or ice that has ceased to fall or to be formed after 10:00 p.m. of any evening may be removed at any time before 10:00 a.m. the next morning.
C. 
The owner of a property shall be responsible for conforming to the requirements of this section where such property is occupied by such owner or is unoccupied; the tenant or occupier thereof where such property is occupied by such tenant or occupier only; and the owner thereof where the property is a multiple-business or multiple-dwelling property occupied by more than one tenant or occupier.
No person shall throw, cast or deposit the snow required to be removed by § 117-1 hereof in the roadbed of the street or highway adjoining such property but shall deposit the same upon the sidewalk along and immediately inside the curb thereof.
In any case where the owner, occupant or tenant, as aforesaid, shall fail, neglect or refuse to comply with any of the provisions of this article within the time limit prescribed herein, the Township authorities may proceed immediately to clear all snow and/or ice from the sidewalk of such delinquents and to collect the expenses thereof, with any additional amount allowed by law, from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed under the provisions of this article.
It shall be unlawful for any owner, occupant or tenant of any property fronting upon or alongside of any of the streets and highways in West Manchester Township to push onto or to dump or deposit or cause to be pushed onto or dumped or deposited onto the cartway of any of said streets or highways any snow or ice which may have fallen upon or accumulated upon said property. It is the specific intent of this section to prohibit the moving or pushing of snow and ice from private driveways and parking lots on to the cartways of streets and highways.

Any owner, occupier or tenant who shall fail to remove any snow or ice from any sidewalk as required by the provisions of this article shall, upon being found liable therefor in a civil enforcement proceeding commenced by West Manchester Township, pay a fine not exceeding $600 plus all court costs, including reasonable attorney's fees, incurred by West Manchester Township. West Manchester Township police officers, the appropriate code enforcement officers of West Manchester Township or other appropriate officer or officers of West Manchester Township shall have the power to enforce the provisions of this article. The amount of the fine imposed for the violation of this article shall be established by the officer who determines that a violation has occurred. Notice of the violation of this article and the amount of the fine imposed shall be given by personal delivery or by certified mail to the person violating this article. If the person violating this article fails or refuses to pay the fine imposed within the period specified in the notice of the violation of this article, the Township shall file a civil enforcement proceeding with the District Magistrate to enforce the fine imposed.

Any owner, occupier or tenant who shall push onto or dump or deposit or cause to be pushed onto or dumped or deposited onto the cartway of any of the streets and highways any snow or ice which may have fallen upon or accumulated on said property shall, upon being found liable therefor in a civil enforcement proceeding commenced by West Manchester Township, pay a fine not exceeding $600 plus all court costs, including reasonable attorney's fees, incurred by West Manchester Township.
