The Borough Council hereby signifies its intention and desire to organize an Authority under the provisions of the Municipality Authorities Act of 1935, as amended.[1]

The Mayor, the President of the Borough Council, and the Secretary are hereby authorized and directed to execute, on behalf of the Borough of Waterford, Articles of Incorporation for said Authority, in substantially the following form:
Articles of Incorporation
TO THE SECRETARY OF THE COMMONWEALTH
COMMONWEALTH OF PENNSYLVANIA:
In compliance with the requirements of the Act of June 28, 1935, P.L. 463, known as the "Municipality Authorities Act of 1935," as amended,[1] the Borough of Waterford, Erie County, Pennsylvania, desiring to incorporate an Authority thereunder, does hereby certify:
(a)
The name of the Authority is the "Municipal Authority of the Borough of Waterford."
(b)
Said Authority is formed under the provisions of the Act of June 28, 1935, P.L. 463, as amended.
(c)
No other authority organized under said Act of June 28, 1935, P.L. 463, as amended, or under the Act of December 27, 1933 (Special Session, 1933, P.L. 114), is in existence in or for the incorporating municipality, the Borough of Waterford.
(d)
The name of the incorporating municipality is Borough of Waterford, Erie County, Pennsylvania, and the names and addresses of its municipal authorities are as follows:[2]
(e)
The names, addresses, and terms of office of the first members of the Board of said Authority are as follows:[3]
(f)
The term of existence of the Authority (originally established September 23, 1941), and thereafter extended by amendment of the Articles for an additional 50 years from November 26, 1963, shall hereby be extended again to a date 50 years from the date of approval of these Articles of Amendment.

The number of members of the Municipal Authority shall be increased to seven members.

The proper officers of the Borough are hereby directed to cause a notice of this article to be published one time in the Erie County Law Journal and in the Waterford Leader, a newspaper published and of general circulation in the County of Erie, as directed by the Act of June 28, 1935, P.L. 463, as amended.[1]
