A Planning Commission consisting of up to nine members, as originally constituted by Ordinance No. 5-1958, is hereby ratified for the Borough of Waterford, Erie County, Pennsylvania, pursuant to the provisions of Article II, Section 201 et seq., of the Pennsylvania Municipalities Planning Code, as established by the Act of July 31, 1968, P.L. 805, No. 247, as amended and reenacted (53 P.S. § 10201 et seq.).
The Planning Commission shall consist of three members to nine members, all of whom shall be citizens of the Waterford Borough of Erie County. The term of office of the members shall be four years and shall expire on December 31 of each four-year term or until a successor is appointed, except that the terms of the members first appointed shall be so fixed that on a commission of eight members or less, no more than two shall be reappointed during any future calendar year, and on a commissions of nine members, no more than three shall be so reappointed or replaced. In the event of vacancies, the Borough Council shall appoint a member to fill the unexpired term.
The Planning Commission shall have all the powers and duties conferred and imposed upon it as set forth in the Pennsylvania Municipalities Planning Code, established by the Act of July 31, 1968, P.L. 805, No. 247, as amended and reenacted (53 P.S. § 10101 et seq.)
