The following regulations shall apply to cemeteries located in West Norriton Township and to parts of cemeteries located in West Norriton Township where cemetery lots are or have been available to members of the public by permission or for a consideration:
1. 
Where a cemetery has been laid out according to a plan showing cemetery lots, roads, lanes, pathways and other features, the proprietor of such cemetery shall furnish a true and correct copy of such plan to the Township Commissioners of West Norriton Township to be kept on file in the Township Office, within 180 days of the effective date of this Part 7.
2. 
All roads, lanes, and pathways appearing on said plan shall at all times be maintained in good order, condition and repair in order to afford ready, convenient and safe access by vehicular or pedestrian use to all parts of said cemetery.
3. 
The entire area occupied by a cemetery shall be maintained by the proprietor thereof in a neat, clean and orderly manner; trash receptacles shall be provided and maintained at convenient intervals throughout the cemetery; and all trash and rubbish shall be periodically removed from said cemetery or otherwise disposed of.
4. 
Where cemetery lots have been sold or conveyed with the right of sepulture only, the proprietor of such cemetery shall cut and remove tall weeds, tall grasses or other obnoxious or objectionable vegetation growth thereon at such intervals as may be necessary at all times to present an appearance of maintenance, to prevent the propagation of and to avoid the spreading of such vegetation to other parts of the Township and to avoid field fires. The clearing of any area in such cemetery by the use of field fires is prohibited.
5. 
Where cemetery lots have been sold or conveyed in fee simple with the right of sepulture, the owners of such lots shall cut and remove tall weeds, tall grasses or other obnoxious or objectionable vegetation growing thereon at such intervals as may be necessary at all times to present an appearance of maintenance, prevent the propagation of and to avoid the spreading of such vegetation to other parts of the Township and to avoid field fires. The clearing of such lots by the use of field fires is prohibited.
6. 
Where a cemetery lot has been sold or conveyed in fee simple with the right of sepulture, the proprietor of the cemetery shall notify the owner thereof, in writing, of any failure on the part of such owner to maintain such lot as required by § 10-701, Subsection 5, of this Part 7; and should any such owner fail, neglect or refuse to so maintain said cemetery lot, the proprietor of said cemetery shall notify the Township authorities in writing of the failure of such owner so to do.
7. 
The proprietor of a cemetery shall remove all dead trees and dead limbs and dead branches of trees from the area occupied by said cemetery.
8. 
The proprietor of a cemetery shall provide an adequate, accessible and convenient water supply for customary cemetery purposes and for the convenience of the lot holders.
9. 
The proprietor of a cemetery shall not interfere with the holders of cemetery lots, whether held for the purpose of sepulture only or in fee simple, from the maintenance and improvement thereof either in parson or by agent, unless such maintenance and improvement infringes upon the rights of other lot holders or interferes with the physical features of the cemetery.
10. 
The proprietor of a cemetery shall not remove and/or destroy grave markers, lot monuments, lot markers or other appurtenances of a cemetery lot without the written consent of the holder thereof being first had and received.
11. 
If the proprietor of a cemetery has, before the effective date of this Part 7, removed from a cemetery lot any grave marker or monument, without the consent of a lot holder, and the same can be located within the confines of such cemetery, the proprietor thereof shall replace the same at the cost of such proprietor upon written request of the holder of such lot.
12. 
Where cemetery lots are unkempt, where graves are sunken, or where grave markers or monuments have fallen or are not adequately based or erect, it shall be the duty of a cemetery proprietor to make diligent search and inquiry as to the identity of the lot holder and to notify such holder in writing as to the condition of such lot.
13. 
Upon request by a duly constituted official of West Norriton Township, the proprietor of a cemetery shall exhibit to such official the records of such proprietor for the sole purpose of informing the Township of the name or names of the holder of holders of cemetery lots, their addresses, the location of their lots, whether the same are held in fee simple or for the purpose of sepulture only, and whether provision has been made, either by the purchase of perpetual care or otherwise, for the maintenance of such lots and the grave markers and monuments located thereon.

Section 10-701, Subsections 4 and 5, of this Part 7 shall not be so construed as to impose upon the proprietor of a cemetery, or upon a lot owner, the same type of care as is required when perpetual care has been purchased or otherwise procured when the lot was acquired or at some subsequent time.

Any person, firm, association or corporation violating any of the provisions of this Part 7 shall forfeit and pay a fine or penalty of not more than $600 to West Norriton Township, the same to be collected by a proceeding before a District Justice in said Township, or recovered as debts of like amount are now, by law, recoverable, and, in default of the payment of such fine and costs, shall be liable to imprisonment of not more than 30 days in the Montgomery County Prison. Whenever such person, firm, association or corporation shall have been notified by West Norriton Township, through its duly constituted representatives, or by service of summons or prosecution, or in any other way, that such violation has been committed, each day that such person, firm, association or corporation shall continue in such violation shall constitute an additional offense punishable by a like fine or penalty.
