As used in this article, the following terms shall have the meanings indicated:
ALCOHOLIC BEVERAGES
Any fluid or solid capable of being converted into a fluid, suitable for human consumption, and having an alcoholic content of more than 1/2 of 1% by volume, including any kind or type of beer, wine or distilled liquors, including blended distilled liquors and any brewed, fermented or distilled liquors fit for use for beverage purposes or any mixture of the same with fruit juices or otherwise.
PUBLIC PLACES
Any place to which the public has access, including any street, highway, road, alley or sidewalk, or a hallway, lobby, roof, basement or office of a public building, or a hallway, lobby, roof, stairway, basement or vacant apartment of a public housing residential project. It shall also include the front or any other outside area of any such public place or of any store, shop, restaurant, tavern or other place of business, or other occupied or vacant private property not owned by or under the control of the person charged with violating this article.
No person shall consume alcoholic beverages in public places, as herein defined, parking lots which are open to the public at large, whether publicly or privately owned, school yards, playgrounds or other outdoor facilities owned and operated by the City Board of Education, shopping plazas or any thoroughfare open to general vehicular traffic in the City.
No person shall consume alcoholic beverages while in any automobile or motor vehicle, whether such automobile is in motion or parked, on any of the public streets, roadways, thoroughfares or in parking lots which are open to the public at large, whether publicly or privately owned, or in playgrounds or outdoor facilities owned and operated by the City Board of Education, or in shopping plazas open to the general public.
Notwithstanding the provisions contained in §§ 58-2 and 58-3, a special permit may be issued by the Board of Commissioners for the consumption of alcoholic beverages, which shall state the terms and conditions as established by the Division of Alcoholic Beverage Control and shall specify the duration of the permit.
Any person who violates any provision of this article, or who fails to comply therewith, shall, upon conviction, for each and every violation and noncompliance, be subject to a fine not to exceed $200 or imprisonment of no more than 90 days in the county jail, or both, at the discretion of the Municipal Court, with a minimum fine of $100 for the first offense.
