The purpose of this article is to regulate the business hours for entertainment venues in the City of Union City in order to:
A. 
Decrease the noise and disturbances associated with large crowds of persons congregating on the streets around entertainment venues between the hours of 2:00 a.m. and 7:00 a.m., in order to benefit the public health, welfare and quality of life of the residents of the City of Union City.
B. 
Discourage criminal activities, especially drug-related criminal activity, and excessive noise, disturbances and injured persons within the City.
As used in this article, the following terms shall have the meanings indicated:
ENTERTAINMENT-RELATED ACTIVITIES
Includes any dancing, any music, any performance or any other activity whose primary purpose is to entertain.
ENTERTAINMENT VENUE
Any dance hall, dance club, social club, catering hall, or any business, whether open to the general public or by membership, occurring in a room, place or establishment where entertainment is the primary activity intended. Entertainment venues shall not include ABC-licensed establishments.
No person, entity or organization shall:
A. 
Operate an entertainment venue, regardless of whether it is public or private, as a dance hall, dance club, social club, or catering hall for the purpose of encouraging or facilitating the gathering of persons for entertainment-related activities between the hours of 2:00 a.m. and 7:00 a.m.
B. 
Permit the use of any building, structure or premises as a dance hall, dance club, social club, or catering hall for entertainment-related activities between the hours of 2:00 a.m. and 7:00 a.m.
A. 
A violation of the provisions of this article shall constitute grounds for a suspension or revocation of any dance hall license or any other entertainment-related license issued by the City of Union City.
B. 
Any person, entity or organization charged with violating this article shall be subject to the hearing provisions set forth in Chapter 234, Licensing of Businesses and Occupations, of the Code of the City of Union City.
C. 
Any person, entity or organization violating this article is subject to the penalty provisions of Chapter 1, Article IV, General Penalty, of the Code of the City of Union City.
