The office of Township Manager is hereby created by the Township of Warminster, Bucks County, Pennsylvania, retroactive to the date it was first established within the Township.

The Manager shall be appointed by a majority of the members of the Board of Supervisors. The Manager shall serve at the pleasure of the Board of Supervisors and may be removed at any time by a majority vote of its members.

The Manager shall be chosen solely on the basis of executive and administrative abilities, with special reference to actual experience in or knowledge of accepted practice with respect to the duties of the offices herein outlined. The Manager need not be a resident of the Township or the Commonwealth of Pennsylvania at the time of appointment, but within one year after his/her selection, the Manager must reside within Bucks County, Pennsylvania.

Prior to commencing the duties of Township Manager, the Township Manager shall give bond to the Township, with a corporate surety, to be approved by the Board of Supervisors, in an amount to be fixed and paid for by the Board of Supervisors in accordance with the provisions of the Second Class Township Code.[1]

The salary and other compensation of the Township Manager shall be fixed, from time to time, by the Board of Supervisors at a public hearing.

The Township Manager shall be the chief administrative officer of the Township and shall be responsible to the Board of Supervisors for the proper and efficient administration of the affairs of the Township. The powers and duties of the Township Manager shall be nonlegislative and shall relate to the general management of the Township's business not expressly, by statute or ordinance, conferred upon any other Township officers or employees. The powers and duties of the Manager shall include, but not be limited to, the following:
A. 
Supervise and be responsible for the activities of all municipal departments.
B. 
Subject to the requirements of the law and the Township's personnel policies, hire, suspend, discharge and discipline all employees under the Township Manager's supervision; provided, however, that the Township Manager shall consult with labor counsel before discharging any employee and shall report at the next meeting of the Board of Supervisors any action taken by the Manager in furtherance of the provisions of this subsection.
C. 
In conformance with the provisions of the Second Class Township Code,[1] prepare and submit to the Board of Supervisors a proposed budget for the succeeding fiscal year, together with a budget message.

D. 
Be responsible for the administration of the budget following its adoption by the Board of Supervisors.
E. 
Be designated to hold such other municipal offices and to head such municipal departments as may be directed by the Board of Supervisors.
F. 
Attend all meetings of the Board of Supervisors and provide notice of said meetings in accordance with law.
G. 
In consultation with the Board of Supervisors, prepare the agenda for each meeting and supply sufficient information so that the Board is familiar with the topic prior to the public meeting.
H. 
Keep the Board of Supervisors informed as to the conduct of the Township affairs, including the submission of periodic reports and the making of necessary recommendations to the Board of Supervisors for action.
I. 
As soon as practical after the close of the fiscal year, submit to the Board of Supervisors a complete report on the financial and administrative activities of the Township for the preceding year.
J. 
Assure the observance of all leases, franchises, permits and privileges granted by the Township.
K. 
Manage the awarding of contracts in accordance with the provisions of law and supervise the performance and faithful execution of same, except insofar as such duties are expressly imposed upon another Township officer by statute or ordinance.
L. 
Assure timely receipt of monies payable to the Township and that proper proceedings are taken for the security and collection of same.
M. 
Act as purchasing officer of the Township in accordance with the provisions of the Second Class Township Code and the Township's policies and procedures; subject, however, to the requirement of the submission of bids to the Board of Supervisors for acceptance.
N. 
Be responsible for all complaints regarding services or personnel of the Township. The Township Manager or his/her designee shall investigate and attempt to resolve said complaints and report thereon to the Board of Supervisors.
O. 
Serve as the duly appointed coordinator of the Americans with Disabilities Act,[2] administering and enforcing the provisions thereof.

P. 
Expend Township funds on an emergency basis and on a nonemergency basis. Funds expended on a nonemergency basis shall be capped at $5,000. If any Township funds are expended, the Manager shall inform the Board of Supervisors of such expenditure no later than the next regularly scheduled meeting of the Board.

In the absence of the Township Manager from the Township, the Township Manager or the Board of Supervisors may appoint an Acting Manager in his/her stead. The duly appointed Acting Manager shall have the powers of the Township Manager in the absence of the Township Manager. The appointment shall be in writing, signed by the Township Manager or the Chairman or Vice Chairman of the Board of Supervisors.
