There is hereby created, effective immediately, a Blighted Property Review Committee (the "Committee"), as authorized and described in § 1712.1 of the Pennsylvania Urban Redevelopment Law (35 P.S. § 1712.1), to address the removal of blighted property. The Committee shall consist of five members, including those representatives as specified by the Act.[1]

Four members of the Committee shall be appointed by the Board of Supervisors and shall include the following: one member of the Board of Supervisors, one representative from the Warminster Township Planning Commission, and two members appointed by the Board of Supervisors, at its discretion. One member of the Committee shall be appointed by the Redevelopment Authority of Bucks County.

Each member of the Committee shall serve a staggered term, beginning with the date of his or her appointment and ending on December 31 of the termination year. The initial terms of the first members shall be so fixed that no more than two members shall be replaced or reappointed during any one calendar year. Vacancies shall be filled within 120 days by the Board of Supervisors or the Redevelopment Authority in accordance with their respective authority to appoint members of the Committee. However, each member shall continue in office after expiration of the term until a successor has been appointed. Their successors shall serve for a term of four years. An appointment to fill a vacancy shall be only for the unexpired portion of the term.

The Blighted Property Review Committee shall have the power and authority to operate under the Act to provide for the designation, certification and removal of blighted property as defined in the Act, to operate in conjunction with and cooperation with the Redevelopment Authority of Bucks County, in order to bring about the acquisition of blighted property by the exercise of eminent domain or otherwise, as authorized by the Act, and elimination of blighted property within the Township. To this end, the Committee shall have all power and authority to do such acts and deeds as are necessary and appropriate to carry out the goals of the Act and this Part 2F.

Notice of the determination by the Committee that a property is blighted property within the meaning of the Act shall be given to the owner of the property or his agent. Such notice shall include a copy of the Committee's resolution certifying the property to be blighted, together with or including an order from the Committee to the owner directing the elimination of the blighted conditions of the subject property. Such notice shall be delivered to the property owner:

By personal service; or
2. 
By certified mail, return receipt requested; or
3. 
By posting a copy of the Committee's resolution and/or order at the subject property and filing a written notice with the local Magisterial District Court having jurisdiction over the property within 10 business days from the date of service.
