[Adopted at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]
A. 
No persons shall hereafter keep or house, horses, ponies, cattle, sheep, swine, poultry or pigeons or any other animal other than household pets within the limits of the Village without a permit from the Board of Trustees. The term "household pet" shall refer to animals that are customarily kept for personal use or enjoyment within the home. Household pets shall include but not be limited to domestic dogs, domestic cats, domestic tropical birds and domestic rodents (such as hamsters and gerbils), but shall not include the aforementioned horses, ponies, cattle, sheep, swine, poultry or pigeons.
B. 
All such permits are subject to the following requirements:
(1) 
The Board of Trustees shall stipulate the maximum number and type of animals to be kept and/or boarded, consistent with the provisions of this article and any other applicable provisions of the Village Code.
(2) 
The Board of Trustees may consider the number and size of animals to be sheltered and impose reasonable conditions to protect neighbors, aesthetic impact and animal safety and minimize noise and smell in order to ensure the health, safety and general welfare of the community, consistent with the provisions of this article and any other applicable provisions of the Village Code.
(3) 
Sewage and waste shall be disposed of by connection of drains to a sanitary sewer or a state, county or locally approved sewage disposal system. Drainage systems shall be provided with back flow prevention devices on submersible inlets and hair traps, if required by law, on all plumbing lines in animal areas where hoses may be attached for cleaning of the facility.
(4) 
All animals shall be kept in clean and sanitary premises, structures or enclosures. All facilities shall be adequately ventilated with fresh or filtered air to minimize drafts, odors and moisture condensation and to provide for the health and comfort of the animals at all times. Ventilation shall be provided by either natural or mechanical means. The necessary equipment or comparable means shall be provided to exhaust the air from the animal area to the outside of the building. The ambient temperature shall be consistent with the requirements of the specific animals.
(5) 
Any owner and/or operator, employee of the owner and/or operator, or agent of the owner and/or operator, shall permit representatives of the Village Enforcement Officer, the Village Dog Control Officer, the Seneca County Health Department, the Seneca County Sheriff's Department, the New York State Police, the State Health Department, the Village Police Department, or any other Village, county or state department or agency that has permitting authority regarding the use of the premises to inspect the premises for the purpose of ensuring compliance with this article at any time it is occupied or open.
(6) 
Such permit may be granted for a period of one year unless revoked earlier upon good cause shown. Good cause shall include, but not be limited to: a finding of the Village Board that the keeping of the animals in question is objectionable or offensive by reason of noise, smell; failure to abide by the requirements of this article; failure to allow inspection of the premises to insure compliance with the provisions of this article; or any other proven violation of federal, state or local law related to the care, custody and/or cruelty to animals.
An offense against the provisions of this article shall be punishable by a fine of not more than $500 or imprisonment for up to 15 days. Each day's continued violation shall be deemed a separate violation.
