This article is enacted in order to provide adequate and accessible
parking facilities for physically handicapped persons in front of
residences, schools, hospitals, and other public buildings and in
shopping and business districts.
A.
The Township Council may, by resolution, establish restricted parking
spaces in front of residences, schools, hospitals and other public
buildings and in shopping and business districts for use by persons
who have been issued special vehicle identification cards by the Division
of Motor Vehicles, or temporary identification cards by a Director
of Public Safety, in accordance with the provisions of N.J.S.A. 39:4-204
et seq.
B.
All restricted parking spaces for handicapped persons established by the Township of Willingboro, the Willingboro Municipal Utilities Authority or established and identified on any shopping center or private parking area prior to the enactment of this article are hereby ratified and shall be deemed established by the Township Council in accordance with Subsection A of this section.
No person shall park any vehicle in any designated handicapped
parking space which does not display a placard or license plate issued
by the Director of the Division of Motor Vehicles, or a temporary
placard issued by a Director of Public Safety, in accordance with
N.J.S.A. 39:4-204 et seq., identifying that vehicle as one used to
transport a handicapped person.
Each parking space or group of spaces which is or are reserved
for the physically handicapped shall be identified with a clearly
visible wheelchair symbol in the parking space and with a sign clearly
visible to the motorist identifying the reserved parking area and
containing the wheelchair symbol. The placement of the signs shall
be at locations approved by the Director of Public Safety or the Director
of Public Safety's designee.
Any person parking a motor vehicle in a restricted parking space
without a special vehicle identification card shall be liable to a
fine of $250 for the first offense and, for subsequent offenses, a
fine of at least $250 and up to 90 days' community service on such
terms and in such form as the court shall deem appropriate, or any
combination thereof.
