Any person who violates any of the provisions of this chapter shall be punished according to the provisions of Chapter 1, General Provisions, Article III, Violations and Penalties, § 1-19, of the Española Code. Each day this chapter is violated shall be considered a separate offense.
A. 
The following is a schedule of mandatory fines:
(1) 
For redemption of impounded animals:
(a) 
First offense: $5.
(b) 
Second offense: $10.
(c) 
Third offense: $20.
(d) 
Fourth offense: confiscation of animal.
(2) 
Unlicensed dogs: $15 plus license fee.
(3) 
Running at large, or animals disturbing the peace:
(a) 
First offense: $10.
(b) 
Second offense: $20.
(c) 
Third offense: $30.
(d) 
Fourth offense: citation for court action pursuant to Subsection B of this section.
(4) 
No rabies vaccination: $10 plus cost of vaccination.
B. 
Any violation of this chapter other than those listed in Subsection A of this section shall be punished as provided in Chapter 1, General Provisions, Article III, Violations and Penalties, § 1-19, of the Española Code. If any person is convicted of cruelty or mistreatment of an animal, that animal shall be removed from his custody and placed with the Director.
C. 
In addition to the mandatory fines for impounded animals pursuant to Subsection A of this section, an additional boarding fee will be charged by the animal control center.
