The Town Park and Plan Commission is established in accordance
with §§ 60.61, 60.66, 62.23 and Ch. 236, Wis. Stats.
The Commission shall immediately assume the duties of a Town Plan
Commission with respect to the Waukesha County Zoning Ordinance, §§ 60.61,
60.66, 62.23 and Ch. 236, Wis. Stats. The Commission shall, when requested
by the Town Board and after compliance with membership requirements,
also assume the duties and exercise the powers of a Town Park Commission
pursuant to § 60.66, Wis. Stats.

A.
The
Commission shall consist of at least seven members to be appointed
by the Town Board Chairperson, subject to confirmation by the Town
Board. The Town Chairman may appoint Town Board members to the Commission.
It is required, however, that at least three citizen members who are
neither Town Board members nor Town officials be on the Commission.
The Town Chairperson may also appoint alternates to serve on the Commission
if necessary to meet quorum requirements or if a member cannot attend
due to personal reasons. Appointments shall be made by the Town Board
Chairperson during the month of April for terms that expire in April.
Members shall be appointed to terms of three years, except the Town
Board member, who shall be appointed for a term of one year. Commissioners
may succeed themselves, and each shall take and file the official
oath. The terms of Commissioners shall be staggered so that not fewer
than two members shall be appointed each year.

B.
Due
to the fact that Commission membership is being revised from five
members with five-year terms to seven members and in order to conform
current members' terms to this amending ordinance, it is necessary
to specify the membership of the current Commission members. The terms
of the current members shall be as follows, expiring in April of the
year set forth:

The Town Plan Commission members shall receive a per-meeting
payment and reimbursement of expenses as from time to time established
by the Town Board by resolution.

The Town Plan Commission shall organize and adopt rules for
its own government in accordance with the provisions of this section.
Meetings shall be held at the Town Hall at the time of the regular
Town Board meetings, and also upon call of the presiding officer of
the Commission or a majority of the full Commission, and shall be
open to the public as required by the Open Meetings Law.[1] The Town Chairperson shall also select the presiding officer.
The secretary of the commission shall be elected by the members of
the Commission annually. A majority of the members of the Commission
shall constitute a quorum of the Commission, and all actions of the
Commission shall require a majority of the full Commission, except
a motion to adjourn. A written record shall be kept showing all actions
taken, resolutions, findings, determinations, transactions and recommendations
made, and a copy shall be filed with the Town Clerk as a public record.

The Town Park and Plan Commission shall have such powers as
may be necessary to enable it to perform its functions and duties
and promote municipal planning. Such powers shall include the following:
A.
All
powers as specified in § 60.66, Wis. Stats., when directed
by the Town Board.
B.
To
appoint such other agents and employees as may be necessary to carry
out its functions and to pay for their services, supplies, equipment
and such other expenses as may be necessary and proper, not to exceed
the appropriations and regulations made by the Town Board.
C.
To
make reports and recommendations relating to the plans and development
of the municipality to public officials, agencies, utilities and other
organizations and citizens.
D.
To
recommend public improvement programs and financing thereof to the
Town Board.
E.
To
request available information from any public official to be furnished
within a reasonable time.
F.
To
enter upon any land in the performance of its functions, make examinations
and surveys and place and maintain necessary monuments and markers
thereon.
The Town Park and Plan Commission shall have the following duties:
A.
To
act as and perform the duties of the Town Planning Agency in administration
of zoning and land division regulations pursuant to §§ 60.61,
62.23 and Ch. 236, Wis. Stats., and the Waukesha County Zoning Ordinance
or Town Zoning Code.
B.
To
make and adopt a master plan for the physical development of the Town
in accordance with § 62.23, Wis. Stats.
C.
To
make and recommend an official map to the Town Board in accordance
with § 62.23, Wis. Stats.
D.
To
prepare and recommend a zoning ordinance, including a zoning district
map, to the Town Board if, and when, necessary.
E.
To
prepare and recommend land division regulations to the Town Board
in accordance with § 236.45, Wis. Stats.
F.
To
make any changes to the master plan it deems necessary or desirable
and to recommend any changes or amendments to the Town Board that
it deems necessary or desirable concerning the official map, zoning,
land division and any other ordinance applicable to community development.
G.
To
consider and report or recommend on all matters referred to it.
The Town Board shall refer to the Commission for its consideration
and report, before final action is taken, the following matters. Unless
such report is made within 30 days or such longer period as may be
stipulated by the Town Board, the Board may take final action without
the report.
A.
Location
and architectural design of any public building.
B.
Location,
acceptance, extension, alteration, vacation, abandonment, change of
use, sale, acquisition or lease of land for any street, alley or other
public way, park, playground, airport, parking area or other memorial
on public grounds.
C.
Location,
extension, abandonment or authorization for any public utility, whether
publicly or privately owned.
D.
Location,
character and extent or acquisition; leasing or sale of lands for
public or semipublic housing, slum clearance, relief of congestion
or vacation camps for children.
E.
Proposed
fire prevention regulations.
F.
All
annexations, incorporations or consolidations affecting the Town.
G.
All
divisions of lands within the Town.
H.
All
proposed or requested changes and amendments to the Town's master
plan, official map, zoning, land division and any other ordinance
applicable to community development.
The Town Park and Plan Commission shall have all additional
powers and duties granted or assigned by the Town Board or by Town
ordinances. All the powers and duties granted or assigned by the Wisconsin
Statutes to planning agencies or commissions and any amendments thereto
and all the powers and duties granted or assigned by the Waukesha
County Zoning Ordinance are hereby granted or assigned to the Commission,
and such statutes are hereby adopted by reference.

The Board of Review shall consist of the Supervisors and Clerk
of the Town, except any person appointed to the office of Town Clerk,
Town Treasurer or to the combined office of Town Clerk and Town Treasurer
under § 60.30(1e), Wis. Stats., may not serve on the Board
of Review. In the event the Town Clerk, Town Treasurer or the person
serving in the combined office of Town Clerk and Town Treasurer is
appointed, the Town Board shall fill the seat on the Board of Review
formerly held by the Clerk, Treasurer or combined Clerk/Treasurer
by an elector of the Town. Members of the Board of Review, except
members who are full-time employees or officers of the Town, shall
receive such compensation as shall be fixed by resolution or ordinance
of the Town Board.
The duties and functions of the Board of Review shall be as
prescribed in § 70.46, § 70.47 and § 70.48,
Wis. Stats., which sections of the Wisconsin Statutes are hereby adopted
by reference.
Whenever the Assessor, in the performance of the Assessor's
duties, requests or obtains income and expense information pursuant
to § 70.47(7)(af), Wis. Stats., or any successor statute
thereto, then such income and expense information that is provided
to the Assessor shall be held by the Assessor on a confidential basis
except, however, that the information may be released to and used
by persons in the discharge of duties imposed by law, in the discharge
of duties imposed by office (including, but not limited to, use by
the Assessor in the performance of official duties of the Assessor's
office and used by the Board of Review in performance of its official
duties) or pursuant to order of a court. Income and expense information
provided to the Assessor under § 70.47(7)(af), Wis. Stats.,
unless a court determines that it is inaccurate, is not, per § 70.47(7)(af),
Wis. Stats., subject to the right of inspection or copying under § 19.35(1),
Wis. Stats.
