A.
Where, in the judgment of the Town Plan Commission, it would be inappropriate
to apply literally the provisions of this chapter because exceptional
or undue hardship would result, the Town Plan Commission may waive
or modify any requirement to the extent deemed just and proper.
B.
Such relief shall be granted without detriment to the public good
and without impairing the intent and purpose of this chapter or the
desirable general development of the community in accordance with
the Comprehensive Plan or Comprehensive Plan component of the Town.
A three-fourths vote of the entire membership of the Town Plan Commission
and a majority vote of the Town Board shall be required to grant any
modification of this chapter, and the reasons shall be entered in
the minutes of the Commission.
C.
In granting variances and modifications, the Plan Commission and
Town Board may require such conditions which will, in its judgment,
secure the objectives of this chapter.
The standards and requirements of these regulations may be modified
by the Town Board upon recommendation of the Plan Commission in the
case of a plan and program for a new Town, a complete community or
a neighborhood unit or planned unit development which, in the judgment
of the Town, provides adequate public spaces and improvements for
circulation, recreation, light, air and service needs of the tract
when fully developed and populated and which also assures conformity
with the Zoning Code regulations of the Town.
The Town Board may, upon recommendation of the Town Plan Commission,
amend, supplement or repeal any of these regulations after public
notice and hearing and as may be required by Ch. 236, Wis. Stats.
