Town of Oconomowoc, WI Vehicles and Traffic

Administrative regulations adopted. The administrative rules and regulations of Ch. Trans 305, Wis. Adm. Code, exclusive of any provisions therein relating to the penalties to be imposed, are hereby adopted by reference and made a part of this Code as if fully set forth herein.

Limitation. A law enforcement officer may not stop or inspect a vehicle solely to determine compliance with Ch. Trans 305, Wis. Adm. Code. A law enforcement officer may issue a citation for a violation of Ch. Trans 305, Wis. Adm. Code, observed in the course stop or inspection made for other purposes, except that a law enforcement officer may not take a person into physical custody solely for a violation of Ch. Trans 305, Wis. Adm. Code.

Noncompliance prohibited. No person shall operate or allow to be operated on any highway, street or alley within the Town a vehicle that is not in conformity with the requirements of Subsection A, or the equipment provisions of Ch. 347, Wis. Stats., or Ch. Trans 305, Wis. Adm. Code.

Owner's liability. Any owner vehicle not equipped as required by this subsection who knowingly causes or permits such vehicle to be operated on a highway is guilty of the violation the same as if he had operated the vehicle. The provisions of § 347.04, Wis. Stats., relating to nonapplicability of demerit points shall apply to owners convicted of violation of this subsection.

Penalty. The penalty for violation of any provision of this subsection, including the provisions of Ch. Trans 305, Wis. Adm. Code, incorporated herein by reference, shall be as provided in Chapter 1, General Provisions, Article I, of the Town Code, together with the costs of prosecution and applicable penalty assessment.

§ 280-2 Parking, stopping and standing.

Generally. There shall be no parking on any roadways in the Town where such prohibition is indicated by official signs of the Town.

Private property. When a sign indicating "No Parking" is clearly posted on private property, no person shall park a motor vehicle thereon without the written permission of the owner or lessee of such property.

Snow season.

No person shall park or leave standing a motor vehicle, trailer, wagon or piece of machinery in the following designated area of the Town from November 1 to April 1 between the hours of 3:00 a.m. and 6:00 a.m.:

Whenever it is necessary to clear Town roads or any part thereof of snow accumulation caused by the previous plowing, the Town Highway Department shall post such roads or parts thereof with signs bearing the words "no parking-snow removal work." Such signs shall be erected at least two hours prior to the time snow removal is to be commenced. No person shall park a motor vehicle in violation of such signs.

Whenever the Town Board, by reason of heavy snowstorm or blizzard, proclaims a snow emergency under § 323.11, Wis. Stats., no person shall park, stop or leave standing any vehicle upon the streets or any portions of the streets during the hours in such proclamation.

If a vehicle has become clearly disabled, the operator of such vehicle shall be exempt from the restrictions in Subsection C(1), (2) and (3) for a reasonable period of time to allow for repair and removal of such vehicle.

Any vehicle found to be in violation of this subsection may be towed away at the owner's expense.

Three-hour parking. Parking between Lacy's Lane and the Lake Drive bridge on the north side of Lake Drive shall be limited to three hours. The Highway Superintendent is directed to erect appropriate signs warning of that restriction.

Okauchee Business District parking regulations. The following parking regulation shall apply within the Okauchee Business District:

No person shall park or leave standing a motor vehicle, trailer, wagon or piece of machinery on Wisconsin Avenue from the east property line of the municipal lot east to the roundabout.

Fifteen-minute parking. Parking between 160 feet east of the intersection of Lacy's Lane and Wisconsin Avenue to 200 feet east of the intersection of Lacy's Lane and Wisconsin Avenue shall be limited to 15 minutes between the hours of 7:00 a.m. and 11:00 a.m. Both parking stalls are located in front of N51 W34949 Wisconsin Avenue.

No person shall park or leave standing a motor vehicle, trailer, wagon or piece of machinery in the right-of-way on the west side of Oakdale Road from Oakdale Road's intersection with Road J to its terminus. No person shall park or leave standing a motor vehicle, trailer, wagon, piece of machinery or recreational vehicle, including boats, within the right-of-way of Oakdale Road as platted but not improved between improved Oakdale Road and Rollefson Road which is adjacent thereto.

Overnight parking. No person, firm, partnership or corporation, nor any officer, member or agent, servant or employee of any firm, partnership or corporation, may leave or park any motor vehicle in any public parking lot overnight without first obtaining a parking permit from the Town of Oconomowoc Police Department. Parking permits shall authorize parking in permit parking areas only. No vehicle shall be parked in a parking permit space for longer than 24 consecutive hours. Permit parking areas shall be clearly marked by the Police Department. Permits shall be issued according to the following procedures:

Application for a parking permit shall be made to the Police Department and shall contain the name and address of the vehicle owner and the registration number of the vehicle for which the permit is intended. Parking permits shall be for a calendar year or monthly.

Annual permits may be issued upon payment of $150. If purchased prior to July 1, the fee shall be pro rated at the rate of $12.50 per month. If purchased after July 1, the rate shall be $15 per month from the date of purchase to the year-end, or for each month for which a permit is issued. If issued after the 14th of any month, the fee for that month shall be $6. In the event the original permit is lost or stolen, a duplicate permit may be issued for a fee of $3. No part of any permit fee shall be refundable.

Guests. Guests of Town residents may park a vehicle in any public parking lot overnight in other than permit parking areas after notifying the Town of Oconomowoc Police Department. This privilege shall not exceed one overnight parking. There shall be no charge.

The all-night parking permit shall be issued by the Police Department upon receipt properly completed application and payment of the fee therefor. The permit shall be issued only to the vehicle owner. No more than one overnight parking permit may be issued to any dwelling unit. For purposes of this subsection, "dwelling unit" shall mean a single-family residence or unit in a multifamily residence; apartments.

Calendar-year permits or permits pro rated for a calendar year shall be of one color, and monthly permits shall be a different color. Permits shall bear such information as, in the opinion of the Police Department, is necessary for identification purposes. When in use, the permit shall be attached by peeling off the backing and affixing the permit decal to the inside upper corner of the rear window on the driver's side. If display permit in the rear window is not possible, the permit should be placed on the inside lower corner of the windshield on the driver's side. This alternate location may be used only if the vehicle does not have a rear window, has a louvered rear window, has a deeply tinted rear window, or has a roll-down rear window (station wagons).

Permitted parking areas and permitted parking spaces shall be marked appropriately by the Police Department. Permitted parking areas will initially be marked only in the public parking lot adjacent to the Holy Trinity Evangelical Lutheran Church property on Wisconsin Avenue.

No person, firm, partnership or corporation, nor any officer, member or agent, servant or employee of any firm, partnership or corporation, may leave or park any motor vehicle in any permit parking area without having first obtained a parking permit from the Town of Oconomowoc Police Department.

Prohibited practices. No person, firm, partnership, or corporation, nor any officer, member, agent, servant or employee of any firm, partnership or corporation, shall park any vehicle of any kind or description in an area reserved for permitted parking when such vehicle is displaying a forged, counterfeited or duplicated Town of Oconomowoc night parking permit, any object mimicking the appearance of such a permit, or any such permit which has been issued for a vehicle other than the one upon which it is displayed. Any penalty imposed under this subsection shall be in addition to any forfeiture imposed for violation of parking regulations.

Penalty.

Any person who shall violate any of the provisions of Subsection D shall, upon conviction of such violation, be subject to the following penalty: a forfeiture of not less than $10 for the first offense, $20 for the second offense, $50 for the third offense, and $50 for each separate offense thereafter during any calendar year. Each violation and each day a violation continues or occurs shall constitute a separate offense.

Any person who shall violate any of the provisions of Subsection G(8) shall, upon conviction of such violation, be subject to a penalty as provided in § 280-10 of this chapter.

Public parking lot regulations. No person, firm, partnership or corporation, nor any officer, member, agent or employee of any firm, partnership or corporation, may park in any municipal parking lot in the Town of Oconomowoc in violation of the following regulations:

Overnight parking is permitted by permit only pursuant to the provisions of Subsections D and G.

No vehicle shall be parked in any municipal parking lot between 3:30 a.m. and 6:00 a.m. except by permit.

No trailer shall be parked in any municipal parking lot, whether attached to a vehicle or not attached to a vehicle.

No truck over 8,000 pounds shall be parked in any municipal parking lot.

Exceptions. The exceptions set forth to stopping and parking restrictions in § 346.50(1), Wis. Stats., are adopted by reference and shall apply to the above subsections of this chapter.

Parking of recreational vehicles (RVs).

"Motorized recreational vehicle" means a motor home built on a truck or bus chassis or a van chassis which usually has a section overhanging the cab. All these vehicles are powered by internal combustion engines that run on gasoline, diesel, batteries or other fuel. Van campers and pickup truck campers are excluded from the recreational vehicle definition.

"Nonmotorized recreational vehicle" means a conventional travel trailer, tent camper or a fifth-wheel trailer utilized for recreational purposes and designed to be towed by a vehicle. Boats, horse trailers, utility trailers for storing recreational equipment or other equipment and all-terrain vehicles stored on trailers utilized for recreational purposes are considered nonmotorized recreational vehicles. Pickup truck camper shells which have been removed from the vehicle and stored are considered nonmotorized recreational vehicles and shall conform to the provisions of this section.

Temporary on-street parking. Temporary on-street RV parking shall be permitted for a maximum of 72 hours at any one time for the purpose of loading and unloading the RV. The Town Chief of Police or designee may extend the time an RV may be parked on-street for an additional 48 hours (maximum).

§ 280-3 Weight limits and heavy traffic routes.

Class "B" highways designated. All streets and alleys within the Town are designated Class "B" highways and shall be subject to the weight limitations imposed by § 348.16, Wis. Stats.

Special and seasonal weight limitations. The Town Board may impose special or seasonal weight limits to prevent injury to the roadway of any highway, bridge or culvert within the jurisdiction of the Town or for the safety of users of such highway, bridge or culvert and shall be responsible for erecting signs giving notice in accordance with § 349.16, Wis. Stats.

§ 280-4 Erection of official signs and signals.

The Town Board, or its assignees, is hereby authorized and directed to procure, erect and maintain appropriate standard traffic signs, signals and markings conforming to the Uniform Traffic Control Devices Manual and giving such notice of the provisions of this chapter as required by state law. Signs shall also be erected in such locations and manner as authorized by the Town Board to give adequate warning to users of the street, road, highway or alley in question.

No person shall intentionally damage, deface, move, remove or obstruct an official traffic sign or signal or intentionally interfere with the effective operation of such sign or signal.

§ 280-5 Abandoned vehicles.

Vehicle abandonment prohibited. No person shall leave unattended any motor vehicle, trailer, semi-trailer or mobile home on any public highway or private or public property, for such time and under such circumstances as to cause the vehicle to reasonably appear to have been abandoned. Except as otherwise provided in this section, whenever any vehicle has been left unattended without the permission of the property owner for more than 48 hours, the vehicle is deemed abandoned and constitutes a public nuisance. A motor vehicle shall not be considered abandoned when it is out of ordinary public view.

Removal and impoundment of abandoned vehicles. Any vehicle in violation of this section shall be impounded until lawfully claimed or disposed of under Subsection C; except if the Chief of Police deems the cost of towing and storage charges for the impoundment would exceed the value of the vehicle, the vehicle may be junked or sold by the Town prior to expiration of the impoundment period, after the Chief determines that the vehicle is not stolen or otherwise wanted for evidence or other reason. All substantially complete vehicles in excess of 19 model years of age shall be disposed of in accordance with Subsection C. If impounded, a storage charge of $3 per day will be assessed.

Disposal.

Any vehicle deemed abandoned by the Chief of Police or his authorized representative and not disposed of under Subsection B shall be stored for a minimum of 10 days after certified mail notice with return receipt requested has been sent to the owner and lienholder of record to permit reclamation of the vehicle after payment of accrued charges.

Such notice shall contain the year, make, model and identification number of the abandoned motor vehicle and place where the vehicle is being held and shall inform the owner and any lienholder of their right to reclaim the vehicle. The notice shall state that the failure of the owner or lienholder to exercise the right to reclaim the vehicle under this section shall be deemed a waiver of all right, title and interest in the vehicle and a consent to the sale of the vehicle.

Each retained vehicle not reclaimed by its owner or lienholder may be sold. The Town may dispose of the vehicle by sealed bid or auction. At such sale, the highest bid for any motor vehicle shall be accepted unless the same is deemed inadequate by the Chief of Police, in which event all bids may be rejected. If all bids are rejected or no bid is received, the Town may either readvertise the sale, adjourn the sale to a definite date, sell the motor vehicle at a private sale or junk the vehicle. Any interested person may offer bids on each abandoned vehicle to be sold.

A public notice shall be posted at the office of the Police Department. The notice posted at the Police Department shall be in the same form as the certified mail notice sent to the owner or lienholder of record.

Upon sale of an abandoned vehicle, the Town shall supply the purchaser with a completed form designed by the Department of Transportation enabling the purchaser to obtain a regular certificate of title for the vehicle.

The purchaser shall have 10 days to remove the vehicle from the storage area, but shall pay a reasonable storage fee established by the Town for each day the vehicle remains in storage from the second business day subsequent to the sale date. Ten days after the sale, the purchaser shall forfeit all interest in the vehicle and the vehicle shall be deemed to be abandoned and may be sold again.

Any listing of vehicles to be sold by the Town shall be made available to any interested person or organization which makes a written request for such list. The Town may charge a fee for the list.

Owner responsible for impoundment and sale costs. The owner of any abandoned vehicle, except a stolen vehicle, is responsible for the abandonment and all costs of impounding and disposing of the vehicle. Costs not recovered by the sale of the vehicle may be recovered in a civil action by the Town against the owner.

Notice of sale or disposition. Within five days after the disposal of the vehicle as provided in Subsection C, the Chief of Police or his authorized representative shall advise the State Department of Transportation, Division of Motor Vehicles, of such sale or disposition on a form supplied by the Division. A copy of the form shall be given to the purchaser of the vehicle and a copy retained on file in the Town.

Junked vehicles.

Prohibited. No person owning or having in his possession or under his control any disassembled, dismantled, junked, wrecked or inoperable motor vehicle or any part of any motor vehicle shall store or permit any such vehicle or part to remain on any private property within the Town for more than 30 days after receipt of the notice referred to in Subsection C. No person owning any private property in the Town shall store or permit any such vehicle or part to remain on his property for more than 30 days. No person, after receipt of such notice, shall remove such motor vehicle or part to any other private property upon which storage is not permitted or onto any public highway or other public property for purposes of storage. Such storage is declared to be a public nuisance and may be abated or removed and penalties imposed as provided in this Code.

Storage permitted. This subsection shall not apply to any motor vehicle or parts stored within an enclosed building, in a storage place or depository maintained in a lawful place and manner or on the premises business enterprise operated in a lawful place and manner when necessary for the operation of such business enterprise. Such business enterprises shall include auto junkyards, auto repair and auto body shops, but shall not include automobile service stations.

Notice of removal. Whenever the Chief of Police or any member of his department finds or is notified that any such motor vehicle or motor vehicle parts have been stored or permitted to remain on any private property within the Town, the Chief of Police or his authorized representative shall serve personally a notice or send a notice by certified mail, return receipt requested, to the owner of record of such motor vehicle or parts, if such owner can be ascertained, and also to the owner of the property upon which it is stored, to remove the vehicle or vehicle parts within 30 days from the date of personal service or mailing. Such notice shall describe the vehicle or parts, order the removal within 30 days and set forth the possible penalties, including removal, with costs borne by the owner of the property.

§ 280-6 Trespass upon private lands and unauthorized operation upon public lands.

Definitions. As used in this section, the following terms shall have the meanings indicated:

MOTOR-DRIVEN VEHICLE

Any conveyance which is propelled by a mechanical power source, whether the same is or is not capable of being licensed to be driven upon the public highways, specifically excepting snowmobiles and all-terrain vehicles which are regulated by § 280-7 of this chapter, and also excepting vehicles actually being operated as maintenance vehicles and those motor-driven vehicles which are operated under circumstances which subject them to regulation by the State Traffic Code and Town traffic ordinances enacted in conformance therewith.

OWNER

All persons or entities which possess any ownership or leasehold interest in a particular private parcel of land upon which motor vehicles as herein defined are presently being operated or are proposed to be operated.

WRITTEN CONSENT

Any dated, written document which is limited to the calendar year in which it is given and which is signed by all persons or entities which possess any ownership or leasehold interest in a particular private parcel of land upon which motor-driven vehicles as herein defined are presently being operated or are proposed to be operated.

Trespass on private property. No person shall operate any motor-driven vehicle upon private property upon which he does not reside or which he does not own, unless he has first received the specific written consent of all owners of such property. Any person apprehended operating any motor-driven vehicle upon private property upon which he does not reside or which is not owned by him shall be presumed to be in violation of this section and such presumption shall be rebutted only by the prompt subsequent display written owner's consent which conforms to this section.[1]

Operation on public lands.

Highways, sidewalks and parks. No person shall operate any motor-driven vehicle upon any public lands, including roadways, road rights-of-way, sidewalks, sidewalk rights-of-way, parklands, waysides, bridle paths, bicycle trails, drainage ditches or basins, unless such area is specifically designated as an area that has been set aside for the operation of motor-driven vehicles or, if the area is a highway, highway right-of-way, street, street right-of-way, sidewalk, sidewalk right-of-way, roadway or road right-of-way. No person operating a motor-driven vehicle shall cross the same except by the most direct route practicable in a safe manner and so as to not disturb the peace, tranquility and property of others.

School premises. No person shall operate a minibike, motorcycle, go-cart or other motor-driven vehicle on any land under the jurisdiction of the Oconomowoc Area School District, except upon a roadway or driveway where such operation has been authorized.

Penalties. Any person who operates a motor-driven vehicle in violation of the provisions of this section shall be liable for a forfeiture of not less than $10 nor more than $25 for conviction first offense under the terms hereof and not less than $20 nor more than $50 upon the second and all subsequent convictions. Failure to pay any such penalty shall be punishable by confinement in the Waukesha County Jail for a term not to exceed 10 days.

§ 280-7 Snowmobiles and all-terrain vehicles.

Applicability of traffic regulations to snowmobiles. The operator of the snowmobile upon a roadway shall, in addition to the provisions of Ch. 350, Wis. Stats., be subject to §§ 346.04, 346.06, 346.11, 346.14(1), 346.18, 346.19, 346.20, 346.21, 346.26, 346.27, 346.33, 346.35, 346.37, 346.39, 346.40, 346.44, 346.46, 346.47, 346.48, 346.50(1)(b), 346.51, 346.52, 346.53, 346.54, 346.55, 346.87, 346.88, 346.89, 346.90, 346.91, 346.92(1), 346.94(1), 346.94(6), 346.94(6)(m)[1] and 346.94(9), Wis. Stats.

All-terrain vehicles. Except as otherwise specifically provided in this chapter, the current and future statutory provisions of § 23.33, Wis. Stats., describing and defining regulations with respect to all-terrain vehicles, are adopted and by reference made a part of this chapter as if fully set forth herein. Any act required to be performed or prohibited by any current or future statute incorporated herein by reference is required or prohibited by this section. Any future additions, amendments, revisions or modifications of the current or future statutes incorporated herein are intended to be made part of this chapter in order to secure uniform statewide regulation of all-terrain vehicles in the Town.

Operation on private premises restricted. No person may operate a snowmobile or an all-terrain vehicle on the private property of another without the consent of the owner or lessee. Failure to post private property does not imply consent for snowmobile or all-terrain vehicle use.

§ 280-8 Speed limits.

Twenty-five miles per hour. The speed limit shall be 25 miles per hour on the following listed Town roads:

§ 280-9 Compression brakes prohibited.

No operator motor vehicle shall use brakes which are in any way activated or operated by the compression of the engine of the motor vehicle or any unit or part thereof, commonly referred to as "Jake brakes," "Jacob's brakes," "engine brakes," or "compression brakes," on any state trunk or county trunk highway within the Town of Oconomowoc, except in cases of emergency. For purposes of this section, "cases of emergency" are defined as circumstances which present an immediate danger to life or property.

Emergency vehicle exceptions. The prohibition set forth in Subsection A of this section shall not apply to "authorized emergency vehicles," as that term is defined by § 340.01(3), Wis. Stats., when responding to an emergency call, when in pursuit of an actual or suspected violator of the law, or when responding but not upon returning from a fire alarm.

§ 280-10 Violations and penalties.

The penalty for violation of any provision of this chapter shall be a forfeiture and penalty assessment if required by § 757.05, Wis. Stats., a jail assessment if required by § 302.46(1), Wis. Stats., plus any applicable fees prescribed in Ch. 814, Wis. Stats.

State forfeiture statutes. Any forfeiture for violation of § 280-1 shall conform to the forfeiture permitted to be imposed for violation of the statutes adopted by reference, including any variations or increases for subsequent offenses.

Local regulations. Except as otherwise provided in this chapter, the penalty for a violation of this chapter shall be as provided in Chapter 1, General Provisions, Article I, of the Town Code.

§ 280-11 Enforcement.

Enforcement procedure. This chapter shall be enforced according to §§ 23.33, 66.0114, 345.11 to 345.61 and Ch. 799, Wis. Stats.

Deposit.

Any person arrested for a violation of this chapter may make a deposit of money as directed by the arresting officer at the Clerk of Court's office or by mailing the deposit to such place. The arresting officer or the person receiving the deposit shall notify the arrested person, orally or in writing, that:

(a)

If the person makes a deposit for a violation traffic regulation, the person need not appear in court at the time fixed in the citation and the person will be deemed to have tendered plea of no contest and submitted to a forfeiture and penalty assessment if required by § 757.05, Wis. Stats., a jail assessment if required by § 302.46(1), Wis. Stats., plus any applicable fees prescribed in Ch. 814, Wis. Stats, not to exceed the amount of the deposit that the court may accept as provided in § 345.37, Wis. Stats.

(b)

If the person fails to make a deposit for a violation traffic regulation or appear in court at the time fixed in the citation, the court may enter a default judgment finding the person guilty of the offense or issue a warrant for his arrest.

The amount of the deposit shall be determined in accordance with the State of Wisconsin Revised Uniform State Traffic Deposit Schedule established by the Wisconsin Judicial Conference and shall include the penalty assessment established under § 757.05, Wis. Stats., a jail assessment if required by § 302.46(1), Wis. Stats., and court costs. If a deposit schedule has not been established, the arresting officer shall require the alleged offender to deposit the forfeiture established by the Constable, which shall include the penalty assessment established under § 757.05, Wis. Stats. Deposits for nonmoving violations shall not include the penalty assessment.
