All persons, firms or corporations wanting to install an individual on-lot sewage disposal system on their property, where the Township sewage system is not available, shall submit an application to the Upper Chichester Township for a permit to install and operate such a system. The application must be made on forms provided by the Pennsylvania Department of Environmental Protection. The sewage disposal system shall meet the applicable requirements of the Pennsylvania Sewage Facilities Act, Act 537,[1] as well as all applicable rules and regulations promulgated thereunder.

No building permit shall be issued by the Township for any property requiring on-site individual or community sewage disposal systems unless and until a permit is obtained indicating that the site, plans and specifications of said system are in compliance with the provisions of the Pennsylvania Sewage Facilities Act, Act 537, P.L. 1535.[1]

A. 
For purposes of enforcement of the provisions of the above Act, the Board of Commissioners shall appoint a competent enforcement officer who shall administer and oversee the testing provided for in the said Sewage Facilities Act.
B. 
For overseeing the required soil suitability testing, the Enforcement Officer shall receive from the applicant an application fee, the amount of which shall be established by resolution of the Board of Commissioners. A portion of said fee shall go to the Township to cover administrative expenses, and the majority shall to the Enforcement Officer as payment for his/her services. Said fee shall cover a period of time not to exceed three hours. The applicant will be responsible for paying the expenses for any time over and above the three hours, as deemed necessary by the Sewage Enforcement Officer, at the rate prescribed in the Township Fee Resolution.
C. 
The Sewage Enforcement Officer shall be compensated at the rate prescribed in the Township Fee Resolution for performing any other services as required to enforce the provisions of the Pennsylvania Sewage Facilities Act or the rules and regulations promulgated thereunder.
D. 
On a monthly basis, the Sewage Enforcement Officer shall submit an itemized account of all services performed during that month. Said account shall include the name of the project, the services performed, the time spent and the amount charged per project.
