The Board of Commissioners of Upper Chichester Township, by Ordinance No. 611, dated June 10, 2004,[1] elected to enforce and administer the provisions of the Pennsylvania Construction Code Act and the Regulations to the Act promulgated by the Pennsylvania Department of Labor and Industry (hereinafter collectively referred to as the "code").

The Southern Delaware County Authority (hereinafter referred to as the "Authority") is a municipal authority organized and existing under the Pennsylvania Municipal Authorities Act, 53 Pa.C.S.A. § 5601 et seq.
The Authority services the sewer needs of Upper Chichester Township and has standards for lateral sewer connections located on private property and connected to public infrastructure owned by a municipality or municipal authority.
Said standards are contained in the Rules and Regulations of the Authority, Section III, Service Connections.
Said code recognizes that said standards that were in effect on January 1, 2005, and that contain provisions that equal or exceed the requirements of the regulations promulgated under said code shall remain in effect until such time as such provisions fail to equal or exceed the minimum requirements of the regulations thereunder promulgated.
The Board of Commissioners of Upper Chichester Township has reviewed said Rules and Regulations and approves of the same.
The Board of Commissioners of Upper Chichester Township hereby approves the Rules and Regulations of the Southern Delaware County Authority, including, but not limited to, Section III, Service Connections.
