A. 
The governing body recognizes a person's right to bail pending trial under Article II, § 13, of the New Mexico Constitution.
B. 
The members of the governing body recognize that there are several forms of bail bonds that an accused may present to the Municipal Court Judge for consideration.
C. 
The governing body recognizes that a bail bondsmen is one of several forms that an accused may utilized pursuant to the Bail Bondsmen Licensing Law, NMSA 1978 § 59A-51-1 et seq.
Therefore, the governing body creates this article to allow individuals accused of a criminal offense the opportunity to utilize the services of a bail bondsman, consistent with New Mexico Statutes and Court rules.
