There is hereby created the Department of Public Safety, which shall consist of the Police Division, Fire Division and Civil Defense Division. These Divisions shall each be directed by and in charge of separate supervisors under the general supervision and control of the Borough Manager.
There shall be a Police Department, organized under provisions of general law, local Charter and ordinances, which shall be headed by the Police Chief.
A. 
Police Chief. A Police Chief shall be appointed by the Borough Manager, who shall possess the training and experience and background work enabling him to perform the duties of his office. The appointment shall be for an indefinite term, covered by general laws and applicable rules and regulations of civil service. He shall receive such salary as is provided in the Salary Ordinance,[1] and the duties of the Police Chief shall be as follows:
(1) 
Analyze the police problems of the municipality.
(2) 
Determine the internal organization of the Police Department.
(3) 
Formulate police rules and regulations.
(4) 
Plan the work so as to make the best use of the available funds, personnel, equipment and supplies.
(5) 
Take the lead in establishing and maintaining helpful and cooperative relations with civic and business organizations, schools, recreational organizations, police authorities and other jurisdictions and all others interested in the maintenance of law and order.
(6) 
See that proper police protection and assistance is provided for large gatherings, for children and other pedestrians in crossing streets, for those engaged in extinguishing fires, for those handling large sums of money and other valuables in transit, and for vacant and unused buildings.
(7) 
Make provisions for police assistance at times and places where traffic is heavy.
(8) 
Direct the detention and apprehension of lawbreakers, the preparation of the charges against them and the collection and presentation of evidence of their misdeeds.
(9) 
Supervise the investigation and disposal of complaints.
(10) 
Give testimony in court.
(11) 
Prepare and supervise the preparation of reports.
(12) 
Direct the establishment and maintenance of needed police records and files.
(13) 
With the advice and consent of the Manager, appoint all necessary personnel to properly operate and function in the best interest of the community. This will include the authority to appoint part-time special police and crossing guards.
(14) 
Enter into an agreement with any person entering the employment of the Borough as an officer in the Borough Police Department and for whom the Borough has expended and will expend funds for training as a police officer, provided that, in the event of voluntary termination of such employment by such officer within one year of the completion of the police training course, the officer shall reimburse the Borough for the entire cost of fees for the police training course and the cost of the officer's uniforms. The agreement shall further provide that an officer who leaves after one year but less than two years after completing the police training course shall reimburse the Borough for 1/2 of the cost of the fees for the police training course and 1/2 the cost for the officer's uniforms. The agreement shall further provide that officers who must resign because of injury or disability or for good cause shall not be obligated to reimburse the Borough, but good cause shall not include better job opportunities. The agreement will further provide that if another municipality, county or an educational institution is responsible to the Borough for training costs pursuant to N.J.S.A. 40A:14-178, the officer will not be obligated to make payment for training costs once payment is received from the municipality, county or educational institution, as applicable.

B. 
Organization.

(1) 
The Police Department may have the following organization under the direction, supervision and control of the Police Chief:

(a) 
Police Lieutenant, one.
(b) 
Police Sergeants, up to three.
(c) 
Police officers, up to nine full-time.
(d) 
Special police officers, as necessary.
(e) 
Senior communications operator, one.
(f) 
Communications operators, up to four full-time.
(g) 
Communications operators, part-time, as necessary.
(2) 
The Borough Council may, by resolution, determine the number of persons in each category, up to the maximum number authorized in this subsection.
C. 
Department qualifications, duties and terms:
(1) 
The Police Chief, under applicable laws and civil service rules and regulations, shall determine the qualifications for each appointment and shall appoint such officers for an indefinite term.
(2) 
Regular officers shall have all of the power and duties prescribed by general law, by the ordinances, resolutions and directives of the Borough Council, and also the powers and duties assigned by the Police Chief and Manager, which are necessary to carry out the operations of the Department. The policewomen and special police shall have only those powers and duties specifically assigned by the rules of the Department and shall not possess those powers assigned regular police officers, prescribed by general law. All such officers shall receive compensation as may be provided for by the Salary Ordinance.[2]

A. 
The Borough Council may appoint at least two constables and may appoint up to five. Said constables shall possess those qualifications and perform those duties as provided by general law and may be regular police officers of the Borough. The term of office shall be for a period of three years, and as constables they shall not receive any compensation from the municipality.
B. 
Constables shall comply with all of the requirements of statutes set forth in N.J.S.A. 40A:9-120 et seq.

The Manager shall appoint an Animal Control Officer or Animal Control Officers, who shall receive such compensation as authorized by the Salary Ordinance,[1] Said Officer shall serve for an indefinite term. The Animal Control Officer shall serve under the immediate supervision of the Police Department and shall be subject to the direction and control of the Police Chief. The Animal Control Officer shall be responsible for the care, supervision and upkeep of the Municipal Pound, following rules and regulations as prescribed by general law, and perform other duties as prescribed by municipal code, state law or regulation.

Building service workers shall be appointed by the Manager to serve for an indefinite term under the applicable laws of civil service. They shall receive such compensation as is provided in the Salary Ordinance[1] and perform the following duties:
A. 
Act as radio-telephone dispatchers for all police and fire calls during their shift of duty.
B. 
Provide all building and ground maintenance services for the fire, police and municipal offices, as directed and determined by the Manager.
C. 
Act as custodian and turnkey for the municipal jail.
D. 
Act as special police, as delegated and required by the Chief of Police, to carry out those orders issued by the Police Chief through patrolmen on duty as their immediate supervisor.

There shall be a Volunteer Fire Department organized heretofore and empowered pursuant to law and local ordinance and the constitution and bylaws of the Washington Fire Department Steamer Company No. 1 and Washington Fire Department Truck Company No. 2. The Department shall be directed and controlled by the officers of the respective corporations, as elected in accordance with their respective bylaws.[1]

A. 
The position of Municipal Disaster Control Director is hereby created. The Director shall be appointed by the Mayor and shall serve a term of three years commencing on July 1, 1987, and shall perform the duties and fulfill the requirements of the position as prescribed by law. The Municipal Disaster Control Director shall appoint a Deputy Municipal Disaster Control Director with the approval of the Mayor, to serve at the pleasure of the Director. Whenever possible, the Deputy shall be appointed from among the salaried officers or employees of the Borough. The Director and Deputy Director shall serve without compensation until and unless the Borough Council establishes a salary or wage in the Salary Ordinance.[1] As a condition of the appointment and right to continue for the full term of his appointment, the Municipal Disaster Control Director shall have successfully completed at the time of his appointment or within one year immediately following his appointment the current, approved Civil Defense Director-Coordinator course. The failure of the Municipal Disaster Control Director to fulfill such requirements within the period prescribed shall disqualify him from continuing in the office of the Director.

B. 
A Local Defense Council with the power and duties prescribed by general law is hereby created. Said Council shall consist of up to 15 persons appointed by and serving at the pleasure of the Manager without any compensation from the municipality. The Municipal Disaster Control Director shall be a member and Chairman of the Local Defense Council.

C. 
The Local Defense Council and the Municipal Disaster Control Director shall assist the municipality in establishing the various local volunteer agencies needed to meet the requirements of all local civilian defense and disaster control activities in accordance with provisions of general law and rules and regulations established by the Governor.
