There shall be a Department of Planning, Zoning and Building, consisting of a Planning Board, Board of Adjustment,[1] Building and Zoning Inspector, and an Economic Development Committee.

A. 
Membership.

(1) 
There shall be a Planning Board, to be composed of nine members, to be appointed as provided in the Municipal Land Use Law, P.L. 1975, c. 291 (N.J.S.A. 40:55D-1 et seq.). The Planning Board shall be as prescribed in the said Municipal Land Use Law and shall be chosen from four classes as provided by N.J.S.A. 40:55D-23(a) for the following terms as follows:
(a) 
Class I: the Mayor, to serve for the duration of his term of office.
(b) 
Class II: one official of the Borough, not a member of the Borough Council, to be appointed by the Mayor for a term of one year.
(c) 
Class III: a member of the Borough Council, to be chosen by the Borough Council for a term of one year or until the member ceases to serve on the Borough Council.
(d) 
Class IV: six citizens of the Borough of Washington, to be chosen by the Mayor, to serve for a term of four years.
(2) 
The Class IV members of the Planning Board shall hold no other municipal office, except that one Class IV member of the Planning Board may be a member of the Board of Adjustment and one Class IV member of the Planning Board may be a member of the Board of Education. In the event that a Class IV member of the Planning Board shall be either a member of the Board of Adjustment or the Board of Education, he shall serve for a term established in N.J.S.A. 40:55D-23(b), notwithstanding any provision of this subsection.[2]

Editor's Note: This ordinance also provided that all members of the Planning Board presently serving on said Board continue in office until the expiration of their present terms, but that any new appointments be made pursuant to the provisions of this ordinance. Further, this ordinance provided that any appointments necessary to fill vacancies created by the adoption of this ordinance shall be filled on the January 1 next following the adoption of this ordinance, for the terms set forth in this ordinance, and that all applications for development made pursuant to lawful authority prior to the effective date of this ordinance may be continued. In addition, the effective date of this ordinance is August 1, 1978.
B. 
Planning staff. The Planning Board shall be empowered to appoint an attorney, staff and consultants, as required, but in no case shall it exceed the appropriation as provided by the Borough Council in its annual budget for said Planning Board.
C. 
The Planning Board shall organize as provided in N.J.S.A. 40:55D-24, and shall exercise such powers as are set forth in the Municipal Land Use Law, specifically in N.J.S.A. 40:55D-25 and 40:55D-26 and N.J.S.A. 40:55D-60 and 40:55D-67.

D. 
No member of the Planning Board shall be permitted to act on any matter in which he has, either directly or indirectly, any personal or financial interest. Any member other than a Class I member may be removed by the Borough Council for cause after a public hearing, if he requests one.

E. 
Any vacancy which occurs other than by the expiration of a term shall be filled by appointment by the designated appointing authority for the unexpired term.

The office of Zoning Officer is hereby created. The Zoning Officer shall serve an indefinite term and shall be appointed by the Borough Manager. The Zoning Officer shall perform and exercise all of the powers, duties and functions now or hereafter vested in the Zoning Officer by law or local ordinance and shall be subject to the jurisdiction and control of the Manager. The salary shall be as provided for in the Salary Ordinance.[1]

The office of Code Enforcement Officer is hereby created. The Code Enforcement Officer shall be appointed by the Borough Manager. The Code Enforcement Officer shall perform and exercise all of the powers, duties and functions now or hereafter vested in the Code Enforcement Officer by law or local ordinance and shall be subject to the jurisdiction and control of the Manager. The Code Enforcement Officer may be appointed to the office of Fire Official by the Borough Manager. The salary shall be as provided for in the Salary Ordinance.[2] This office may be combined with the office of Zoning Officer.
